PLANNING FILE 3663 <br />144 <br />Request by Pulte Homes of MN, LLC for VACATION of a storm sewer easement in <br />145 <br />support of the proposed plat of property in the NW corner of Lexington Avenue <br />146 <br />and County Road C-2 <br />147 <br />Chair Boerigter opened the Public Hearing at 6:10 p.m. <br />148 <br />Associate Planner Bryan Lloyd reviewed the request of Pulte Homes for vacation of the <br />149 <br />existing storm sewer easement that crosses the parcel at the intersection of Lexington <br />150 <br />Avenue and County Road C-2. Mr. Lloyd noted that a reconstructed storm sewer line will <br />151 <br />be located within a new easement and rights-of-way as part of the current plat of the <br />152 <br />property, as detailed in Section 5.1 of the Request for Planning Commission Action <br />153 <br />(RPCA) dated April 6, 2011report. <br />154 <br />Staff recommended approval of the proposed EASEMENT VACATION of the property in <br />155 <br />the northwest corner of Lexington Avenue and County Road C-2; based on the <br />156 <br />comments and findings of Sections 4-6, and the conditions of Section 7 of the RPCA <br />157 <br />dated April 6, 2011. <br />158 <br />Discussion among Commissioners and staff included ramifications should the Pulte <br />159 <br />Homes project not proceed; with staff advising that the vacation request would coincide <br />160 <br />with Final Plat approval at the City Council level; and that the Public Improvement <br />161 <br />Contract would provide further stipulations and guarantees. <br />162 <br />The applicant was not present at tonight’s meeting. <br />163 <br />Public Comment <br />164 <br />Chair Boerigter closed the Public Hearing at 6:14 p.m.; no one spoke for or against. <br />165 <br />Member Gisselquist, for the benefit of new Commissioners and/or those Commissioners <br />166 <br />not present at previous discussions related to the Pulte Homes project and Preliminary <br />167 <br />Plat review by the Planning Commission, opined that this request represented additional <br />168 <br />fine-tuning of the plat proposal, and should cause no concern. <br />169 <br />MOTION <br />170 <br />Member Gisselquist moved, seconded by Member Boerigter to RECOMMEND <br />171 <br />APPROVAL of the proposed EASEMENT VACATION of the property in the <br />172 <br />northwest corner of Lexington Avenue and County Road C-2; based on the <br />173 <br />comments and findings of Sections 4-6, and the conditions of Section 7 of the <br />174 <br />RPCA dated April 6, 2011. <br />175 <br />Ayes: 7 <br />176 <br />Nays: 0 <br />177 <br />Motion carried. <br />178 <br />It was noted that this case is scheduled to be heard at the April 18, 2011 City Council <br />179 <br />meeting. <br />180 <br />d. PLANNING FILE 3663 <br />181 <br />Request by Ramsey County for renewed approval of the household hazardous <br />182 <br />waste collection site at Kent Street and Larpenteur Avenue as an INTERIM USE <br />183 <br />Chair Boerigter opened the Public Hearing at 6:16 p.m. <br />184 <br />Associate Planner Bryan Lloyd reviewed the request, as detailed in the Request for <br />185 <br />Planning Commission Action (RPCA), of the Ramsey County Department of Public <br />186 <br />Health for a five (5)-year extension of their INTERIM USE approval to allow continuation <br />187 <br />of the operation of a satellite household hazardous waste (HHW) collection facility at the <br />188 <br />County’s site along Kent Street just north of Larpenteur Avenue, pursuant to City Code, <br />189 <br />Chapter 1009.03 (Interim Uses). Mr. Lloyd advised that the Development Review <br />190 <br />Committee recommended renewal based upon their review. <br />191 <br />Staff recommended a five (5)-year renewal of the INTERIM USE for Ramsey County to <br />192 <br />continue operating a HHW collection facility at the Kent Street location; based on the <br />193 <br /> <br />
