Hazard Placement: No tree, shrub or herbaceous plant shall be planted, placed or <br /> 2 allowed to remain in a place which the City Engineer determines could cause a traffic <br /> 3 hazard. <br /> 4 <br /> 5 B. Boulevard Planting: Trees, shrub or herbaceous plants must be located within the <br /> 6 first three feet of the boulevard, measured from the property line. Plants shall be <br /> 7 consistent with the Street Tree Master PlaA In t ng Plan and not in conflict with <br /> 8 public plantings based on the judgment of the City Forester HeFti^„'tSt Planting <br /> 9 will be by permit only. <br /> 10 <br /> 11 C. Spacing/Placement: Placement of trees, shrubs or herbaceous plants must be <br /> 12 consistent with Sections 706.06 through 706.08 and the regulations listed in the <br /> 13 Street Tree Master Plan. <br /> 14 <br /> 15 D. Abuse or Mutilation: No person shall on public property and right of way: <br /> 16 <br /> 17 1. Damage, cut, remove, carve, kill or injure trees, shrubs or herbaceous <br /> 18 plants. ti <br /> 19 <br /> 20 2. Trim, prune, remove, spray or otherwise treat trees, shrubs or herbaceous <br /> 21 plants without first obtaining a Street Tree Permit <br /> 22 <br /> 23 3. Attach any rope, wire or other contrivance to any tree, shrub or <br /> 24 herbaceous plant. <br /> 25 <br /> 26 4. Cause or permit any wire charged with electricity or any gaseous liquid or <br /> 27 solid substance to come in contact with trees, shrubs or herbaceous plants <br /> 28 which are located on, or extend over, any public street, boulevard, park or <br /> 29 other public place without a permit. <br /> 30 <br /> 31 E. Street Tree Permits: <br /> 32 <br /> 33 1. No person shall plant or remove trees, ef shrubs, or herbaceous plants on a public <br /> 34 boulevard without first obtaining a Street Tree permit from the Parks and Recreation <br /> 35 Director/City Forester, or designated staff <br /> 36 <br /> 37 2. The following provisions apply to the issuance of Street Tree permits for planting <br /> 38 trees, shrubs and/or herbaceous plants "r' "V on public property, especially <br /> 39 the boulevard: <br /> 40 <br /> 41 a. Application Data: The application required under this Section shall state the <br /> 42 number of trees, shrubs and/or herbaceous plants to be planted, the location, <br /> 43 size and specific species of each tree or plant. <br /> 44 <br /> 45 b. Standards for Issuance: A permit shall be issued after the application has <br /> 46 been determined to be in compliance with the Street Tree Master <br /> 47 Plan and the requirements of this Section and related sections by the City <br /> 48 Forester Delvxelepffiment Review Gemmmttee. <br /> 49 <br /> 50 c. Replacement: As a condition to the granting of a tree removal permit, the <br /> 51 City Forester may require the applicant to relocate or replace trees to be <br /> 52 consistent with the Street Tree Master Plan. <br /> 53 <br /> 54 d. Bond Requirements: A posted bond or cash escrow may be required in an <br /> 55 amount to be determined by the City Forester HeFtie ,' . ,, conditioned upon <br /> 5 <br />
