Boulevard Planting: Trees, shrub or herbaceous plants must be located within the 6 first three feet of the boulevard, measured from the property line. Plants shall be 7 consistent with the Street Tree Master PlaA In t ng Plan and not in conflict with 8 public plantings based on the judgment of the City Forester HeFti^„'tSt Planting 9 will be by permit only. 10 11 C. Spacing/Placement: Placement of trees, shrubs or herbaceous plants must be 12 consistent with Sections 706.06 through 706.08 and the regulations listed in the 13 Street Tree Master Plan. 14 15 D. Abuse or Mutilation: No person shall on public property and right of way: 16 17 1. Damage, cut, remove, carve, kill or injure trees, shrubs or herbaceous 18 plants. ti 19 20 2. Trim, prune, remove, spray or otherwise treat trees, shrubs or herbaceous 21 plants without first obtaining a Street Tree Permit 22 23 3. Attach any rope, wire or other contrivance to any tree, shrub or 24 herbaceous plant. 25 26 4. Cause or permit any wire charged with electricity or any gaseous liquid or 27 solid substance to come in contact with trees, shrubs or herbaceous plants 28 which are located on, or extend over, any public street, boulevard, park or 29 other public place without a permit. 30 31 E. Street Tree Permits: 32 33 1. No person shall plant or remove trees, ef shrubs, or herbaceous plants on a public 34 boulevard without first obtaining a Street Tree permit from the Parks and Recreation 35 Director/City Forester, or designated staff 36 37 2. The following provisions apply to the issuance of Street Tree permits for planting 38 trees, shrubs and/or herbaceous plants "r' "V on public property, especially 39 the boulevard: 40 41 a. Application Data: The application required under this Section shall state the 42 number of trees, shrubs and/or herbaceous plants to be planted, the location, 43 size and specific species of each tree or plant. 44 45 b. Standards for Issuance: A permit shall be issued after the application has 46 been determined to be in compliance with the Street Tree Master 47 Plan and the requirements of this Section and related sections by the City 48 Forester Delvxelepffiment Review Gemmmttee. 49 50 c. Replacement: As a condition to the granting of a tree removal permit, the 51 City Forester may require the applicant to relocate or replace trees to be 52 consistent with the Street Tree Master Plan. 53 54 d.
