... .. . ... 1) Yellow Dog Holdings, LLC has submitted application for approval of a pawn <br />32, shop as a conditional use at 2057 Snelling Avenue in Roseville, Minnesota. <br />33 2) The subject property has a Comprehensive Land Use designation of Community <br />34 Business and a corresponding Zoning Classification of Community Business <br />35 District. Section 1005.03 of the Roseville City Code allows pawn shops as a <br />36 conditional use in Community Business Districts subject to the provisions of <br />3 7' Section 1009.02C of the City Code <br />38 3) Section 1009.02C of the Roseville City Code provides that the Roseville City <br />39 Council must make the following findings to approve a conditional use.- <br />40 a. The proposed use is not in conflict with the Comprehensive Plan; <br />41 b. The proposed use is not in conflict with any Regulating Maps or other <br />42, adopted plans; <br />43 c. The proposed use is not in conflict with any City Code requirements; <br />44, d. The proposed use will not create an excessive burden on parks,, streets,, <br />45 and other public facilities; and <br />46 e. The proposed use will not be injurious to the surrounding neighborhood, <br />4`7 will not negatively impact traffic or property values, and will not <br />48 otherwise harm the public health, safety, and general welfare. <br />49 4) The location of the proposed use is near an elementary school,, a residential <br />50 neighborhood, and other major retail businesses. <br />51 5) Evidence was presented that an existing pawn shop located in the City of <br />52, Roseville has had incidents of criminal behavior associated with it,, involving the <br />53 receipt of stolen items. The number of criminal incidents, averaging slightly fewer <br />54 than two per week, is significantly more than other types of businesses and <br />55 represents an increase in crime in the area. <br />56 6) Historically, pawn shops have been associated with criminal behavior, which has <br />5 7' led to State and City regulation, but such regulation is not necessarily effective at <br />58 deterring certain types of crime, which can lead to an increase in crime in <br />59 surrounding businesses and the surrounding area. <br />60 7) The record includes testimony indicating that the close proximity to other retail <br />61 establishments can lead to an increase in crime and theft in those establishments,, <br />62, insofar as the pawn shop provides an outlet for the sale of small items without <br />63 serial numbers. <br />64 8) The record includes testimony indicating that the presence of a pawn shop in the <br />65 neighborhood gives rise to adverse impacts on the perception of the desirability of <br />66 the neighborhood as a livable, crime-free area. <br />Page 2 of 4 <br />
