assign, loan, or otherwise provide the Fiber Capacity or any portion thereo to a <br />third party, or extend the Fiber Capacity to any other facility either owned by the <br />Grantee,, or a third party. <br />E. The Grantee acknowledges that the Grantor may move the fiber optic lines on <br />which the Fiber Capacity is located during the term of this Agreement or any <br />extension thereof. The Grantor and its officers,, directors,, employees, volunteers <br />and agents shall not be liable for any loss, claim, penalty, cost, expense (including <br />attorneys' fees)�, damage, death or injury arising out of or attributable to such <br />movement. The Grantor will promptly notify the Grantee of any plans to move <br />the fiber lines on which the Fiber Capacity is located after it becomes aware of <br />any such plan. If the fiber lines on which the Fiber Capacity is located are moved <br />by the Grantor in an emergency situation,, then the Grantor shall promptly notify <br />the Grantee of the movement after it becomes aware of the movement. <br />P <br />A. The Grantor will promptly notify the Grantee of any planned City Network <br />outages affecting the Fiber Capacity after it becomes aware of such planned <br />outages. Examples of such planned outages may include, but are not limited to, <br />testing and maintenance of the City Network and movement of utility poles. The <br />Grantor has no obligation to notify the Grantee of planned outages of which it is <br />not aware. The Grantee will contact the Grantor if any of the Grantee's <br />equipment must be removed during an outage. The Grantee shall be responsible <br />for removing its equipment. <br />B. Unplanned City Network outages shall be handled as follows.- <br />First Awareness- Grantee <br />a. If the Grantee experiences an outage, testing shall be performed by <br />the Grantee to determine if a connection can be made to the Data <br />Center location. This will determine if the problem is on the <br />Grantee's network equipment. <br />b. If a connection can be made to the Data Center,, the Grantee will <br />contact the Grantor. <br />C. If the problem is in the Fiber Capacity connecting the School to the <br />Data Center,, the Grantor will be responsible for problem <br />resolution. <br />2. First Awareness- Grantor <br />If the Grantor is first aware of an unplanned outage, the Grantor will <br />notify the Grantee as soon as possible. <br />C. The Grantor does not guarantee the uninterrupted transmission of signals over the <br />City Network. <br />D. The Grantor shall not be responsible for the protection of any and all Grantee <br />
