Attachment G <br />I PUBLIC IMPROVEMENT CONTRACT <br />2 HIGH CREU PA. KADDITION <br />3 <br />4 I. Parties. This Agreement, dated July _, 2011, is entered into between the City of Roseville, a <br />5 Minnesota municipal corporation, 2660 Civic Center Drive, Roseville, Minnesota 55113 ("the <br />6 City"')�, and Meritex Enterprises, Inc, a Minnesota Corporation ("the Developer"')�. <br />7 11. Request for Plat approval. The Developer has asked the City to approve a plat of land to be <br />8 known as "Highcrest Park A ddition " (also referred to in this Agreement as the "Plat"' . The land <br />9 is legally described as follows.- <br />10 See Legal Description attached as Exhibit A hereto (the (Property" <br />I I III. Terms and Conditions of Plat Approval. Now, therefore, in reliance upon the representations <br />12 contained herein,, and in consideration of the mutual undertakings herein expressed, the parties <br />13 agree as follows.- <br />14 A. Conditions of Plat Approval: The City hereby approves the Plat on the condition that.- <br />15 A. The Developer enter into this Agreement, and <br />16 B. The Developer provide the necessary security in accordance with this Agreement. <br />17 B. Land Use Approvals.- The Plat consists of one commercial lot and one outlot. The Property is to be <br />18 improved with the following.- sanitary sewer line and pathway. <br />19 C. Public Improvements. The Developer shall, subject to the terms and conditions contained herein, <br />20 perform the following work and construct the following improvements ("Public Improvements") in <br />21 compliance with City approved plans and specifications described in Section III D below and all <br />22 rules,, regulations, standards and ordinances of the City.- <br />23 1. Site Grading and Turf Restoration. The Developer shall grade the all portions of the Property <br />24 affected or disturbed by the construction of the Public Improvements in accordance with the City <br />25 approved Grading, Drainage and Erosion Control Plan. Grading improvements shall include <br />26 common excavation,, subgrade correction, embankment and turf restoration. Turf restoration <br />27 shall include seeding, mulching and erosion control. <br />28 All improvements to the lots and the final grading shall comply with the approved <br />29 grading plan <br />30 2. Pathway. The Developer shall construct a 6 foot wide pathway along the Walnut Street side <br />31 of Lot L Block L Highcrest Park Addition. The pathway shall be constructed in accordance <br />32 with City details, specifications, and the City approved Public Improvement Construction Plans. <br />33 3. Sanitary sewer construction.- The Developer shall construct all sanitary sewer pipes <br />34 determined to be necessary by the City to serve the Property, including individual lot services. <br />35 a) All sanitary sewer improvements shall be constructed in accordance with City details, <br />36 specifications, and the City approved Public Improvement Construction Plans. <br />37 b) Street patching/ replacement of bituminous pavement and base and concrete curb and <br />38 gutter in the areas disturbed by the sanitary sewer connection construction shall be to <br />39 match existing conditions prior to street removal. <br />Page 1 of 15 <br />
