Attachment G <br />I c) All sub grade excavation and filling shall be completed by the Developer in <br />2 accordance with City details, City specifications, VDT's specifications (if applicable), <br />3 and the approved construction plans. <br />4 d) The City reserves the right to test as necessary, at the Developer's expense, all <br />5 excavation work. <br />6 e) All sanitary sewer improvements shall be constructed in accordance with City details, <br />7 specifications, and the City approved Public Improvement Construction Plans. <br />8 4. Storm Sewer Inspection and Repair.- The Developer has requested that the City take over <br />9 ownership of a portion of the private storm sewer that exists on the site. The City shall accept <br />10 ownership provided that the following items are completed to the satisfaction of the City <br />I I Engineer.- <br />12 a) The pipe shall be televised to determine the condition and if it is in conformance with <br />13 City Specifications. Pipe found to be deficient will need to be repaired or replced to meet <br />14 current City details and specifications. <br />15 b) The structures on the pipe will need to be inspected to determine the condition and if <br />16 they are in conformance with City Specifications. Structures found to be deficient will <br />17 need to be repaired or replaced to meet current City details and specifications. <br />18 c) The pipe shall be covered by an easement on the final plat. <br />19 5. Erosion control. Prior to any grading and before any utility construction is commenced or <br />20 building permits are issued, the erosion control plan shall be implemented, inspected and <br />21 approved by the City. The Developer shall meet all requirements of the City's Erosion Control <br />22 Ordinance including but not limited to the following.- <br />23 a) No construction activity shall be allowed and no building permits shall be issued <br />24 unless the Property is in full compliance with the erosion control requirements. <br />25 b) Measures shall be installed in compliance with MPCA NPDES permit requirements. <br />26 c) To remove dirt and debris from streets that has resulted from construction work by <br />27 the Developer, its agents or assigns, the Developer shall sweep Walnut Street on a weekly <br />28 basis or more frequently as directed by the City Engineer until the site is stabilized. <br />29 Developer must sweep roadways with a water-discharge broom apparatus. Kick-off <br />30 brooms shall not be utilized for street sweeping. <br />31 d) If the development on the Property does not comply with the erosion control plan or <br />32 supplementary instructions received from the City,, the City may, following giving the <br />33 Developer 48 hour prior oral notice or in the event of an emergency immediately) take <br />34 such action as it deems appropriate to control erosion, the cost of which action shall be <br />35 paid by the Developer to the City upon demand. <br />36 D. Development Plans. The Property shall be developed in accordance with the following plans, <br />37 specifications and other documents ("Plans" �. With the exception of the Plat, the Plans may be <br />38 prepared after the parties have entered into this Agreement, provided however, no work shall be <br />39 commenced on the Property until all of the Plans have been submitted to and approved by the City. <br />40 The Plans shall not be attached to this Agreement, but shall be retained in the City files while the <br />41 work to be done under this Agreement is being performed.
