Attachment A 1 2 City of Roseville 3 ORDINANCE NO. 4 5 AN ORDINANCE ADDING CHAPTER 410 TO TITLE FOUR OF THE 6 ROSEVILLE CITY CODE REGULATING THE USE OF COAL TAR BASED 7 SEALER PRODUCTS WITHIN THE CITY OF ROSEVILLE, MINNESOTA 8 9 THE CITY OF ROSEVILLE ORDAINS: 10 1.1 SECTION 1: Chapter 410 is hereby added to Title Four of the Roseville City 12 Code: 13 14 SECTION: 15 410.01: Purpose 16 410.02: Definitions, 17 410.03: Prohibitions, 18 410.04: Exemption 19 410.05: Asphalt -Based Sealcoat Products 20 410.06: Penalty 21 410.07: Severability 22 410.01: PURPOSE 23 The City of Roseville understands that lakes, rivers, streams and other bodies of water are natural 24 assets which enhance the environmental,, recreational, cultural and economic resources and 25 contribute to the general health and welfare of the community. The City of Roseville 26 Comprehensive Plan supports protection of these resources. 27 28 The use of sealers on asphalt driveways is a common practice. However, scientific studies on the 29 use of driveway sealers have demonstrated an adverse relationship between storm water runoff 3 and certain health and environmental concerns. 31. 3 The purpose of this ordinance is to regulate the use of sealer products within the City of 3 3 Roseville,, in order to protect,, restore,, and preserve the quality of its waters. 3 4 410.02: DEFINITIONS 3 5 Except as otherwise provided or clearly implied by context,, all terms shall be given their 3 commonly accepted definitions. For the purpose of this ordinance, the following definitions 3 7 shall apply unless the context clearly indicates or requires a different meaning. 3 8 ASPHALT-BASED SEALER.- A petroleum-based sealer material that is commonly used on 3 driveways, parking lots, and other surfaces and which does not contain coal tar. 40 COAL TAR SEALER.- A coal tar based sealer is a black liquid containing coal tar pitch that is 41 sprayed or painted on asphalt parking lots and driveways.
