42 COAL TAR.- A byproduct of the process used to refine coal for the steel industry. 43 CITY: City of Roseville. 44 MPCA: Minnesota Pollution Control Agency 45 PAHs: Polycyclic Aromatic Hydrocarbons. A group of organic chemicals formed during the 46 incomplete burning of coal, oil, gas, or other organic substances. Present in coal tar and believed 47 harmful to humans,, fish,, and other aquatic life. 49 A. No person shall apply any coal tar based sealer to any driveway, parking lot, or other surface 50 within the City of Roseville. 51 B. No person shall contract with any commercial sealer product applicator, residential or 52 commercial developer, or any other person for the application of any coal tar based sealer to 5 3 any driveway, parking lot, or other surface within the City. 54 C. No commercial sealer product applicator, residential or commercial developer, or other 55 similar individual or organization shall direct any employee, independent contractor,, 56 volunteer,, or other person to apply any coal tar based sealer to any driveway, parking lot, or 57 other surface within the City. 58 D. A person may not sell a coal tar based sealer product within the City, unless.- 59 1. The sale is to a person who intends to use the coal tar based sealer outside the City's 60 planning jurisdiction; and 61 2. The seller requires the purchaser to complete and sign a form provided by the City that 62 includes.- 63 a. The name,, address,, and phone number of the purchaser, 64 b. The date of the purchase, 65 c. The quantity of coal tar based sealer purchased, 66 d. A statement that the coal tar based sealer will not be used within the City of 67 Roseville,, 68 e. An affirmation by the purchaser that the information on the form is correct, and 69 f. The seller retains the completed form for a period of not less than two years and 70 allows the City to inspect or copy the form upon request. 71 410.04: EXEMPTION 72 Upon the express written approval from both the City and MPCA, a person conducting 73 bona fide research on the effects of coal tar based sealer products or PHA s on the 74 environment shall be exempt from the prohibitions provided in Section 3. 75 410.05: ASPHALT -BASED SEALCOAT PRODUCTS 76 The provisions of this ordinance shall only apply to use of coal tar based sealer in the 77 City and shall not affect the use of asphalt-based sealer products within the City. 78 410.06: PENALTY 79 Any person convicted of violating any provision of this ordinance is guilty of a 80 misdemeanor and shall be punished by a fine not to exceed one thousand dollars
