143 The City will pay all costs of any City special election that is not conducted on the 144 date of a regularly scheduled City, Count y or state election. The City will also pay 145 all costs applicable to the City of any state special election that is not conducted 146 on the date of a regularly scheduled City, Count y or state election. 147 148 The Count y will submit an in�voice payable within 30 days of receipt to the City for 149 all costs incurred by the Count y to conduct a special election. 150 151 9. Insurance 152 153 During the term of this con�tract, the Count y an�d City will maintain, through 154 com�m�ercially available in�suran�ce or on a self- insured basis, property insurance 155 coverage on the voting equipm�en�t each awns, for the repair or replacement of 156 the voting equipm n�t if dam ged or stolen�. Each party shall be responsible for 157 any deductible under its respective policy., Each party h�ereby waives an�d 158 releases the other party, its em loyees, agents, officials, an�d officers from all 159 claim�s, liability, an�d causes of action for loss, dam ge to or destruction of the 160 waivin�g party's property resultin�g from fire or ether perils covered in the stan�dard 161 property insurance coverage mint in d by the party. Furth rm�ore, each party 162 agrees that it will look to its own property insurance for reim�bursem n�t for any 163 loss an�d shall h ve no rights of subrogation against the other party., 164 165 10., Inderrinification 166 167 Each party to this con�tract will defend, hold harmless, an�d indemnify the other 168 party, its officials, agents, an�d em loyees from any liability, loss, an�d dam ge it 169 may suffer as a result of dem n�ds, claim�s, judgments, or costs including, but not 170 limited to, attorneys' fees an�d disbursem n�ts, arising out of or related to the 171 indemnifying party's performance or failure of performance under this con�tract., 172 This provision shall not be construed nor operate as a waiver of any applicable 173 limits of or exceptions to liability provided by Min�n�esota Statutes Ch ter 4,66 or 174 otherwise set by law.
