PRESUMPTIVE PENAOY APPROVAL <br />114 <br />.,VATLTNI'S ALCOHOL LICENSE SUSPENSION <br />MIRX""11611le <br />On June 4,, 2007, all businesses with a liquor license in the City of Roseville were mailed a letter from the <br />Roseville Police Department announcing two alcohol compliance checks would be conducted before the <br />end of th-e year. Also in the letter were materials for an optional manager/server training program and a <br />list of City of Roseville approved training programs. Proof of the completed training by all employees <br />selling or serving alcobol had to be submitted to the Roseville Police Department by or on July 6, 2007. <br />On August 18, 2007, a Roseville Police Officer, along with an underage buyer, entered Davanni's to <br />conduct an alcohol compliance check. The underage buyer approached the cashier and ordered a bottle of <br />Bud Light beer. The cashier asked the underage buyer for ID and the underage buyer provided the cashier <br />with his real MN Driver's License with the words, "Under 21," stamped on the license. The cashier took <br />the license, looked at it, and gave it back to the underage purchaser. The cashier then sold the underage <br />buyer a bottle of Bud Light. The cashier was issued a citation on scene and released. Davanni's did <br />participate in an optional manager/server training program and has two documented failures with the <br />Roseville Police Department—one in 2001 and a second in 2005. On August 13, 2007, the City Council <br />heard all the evidence presented and proposed to impose the presumptive penalty for a second offense for <br />an establishment that does participate in Roseville's optional manager/server training program on a one <br />day suspension and a $500.00 fine. The Police Chief made the determinati'on the suspension of Da. vanni's <br />liquor license would be November 2, 2007. Sergeant Marshall completed a letter of notice to Davanni's <br />with the Council's decision!, the fine and date of suspension, and information on requesting a hearing. <br />This letter was hand delivered to Davanni's by a Roseville Community Service Officer (CS O). Davanni's <br />did not respond to the letter. <br />
