1 DRAFT <br />2 CITY of ROSEVILLE <br />3 PLANNED UNIT DEVELOPMENT AGREEMENT 7 -� 3 6�2 <br />4 <br />5 This PLANNED NIT DEVELOPMENT AGREEMENT ("AGREEMENT"'), dated <br />6' March 24, 2008 is entered into between the City of Roseville, a Minnesota municipal <br />corporation, of 2660 Civic renter Drive, Roseville, Minnesota 5511 ("CITY"') and R F <br />LLC, (Roundy"s) 67'�5 East Wisconsin Avenue, Milwaukee, Wt 53201 ("DEVELOPER"'). <br />For reference the City of Roseville project file 1s PF -00.x. <br />10 <br />11 1.0 EFFECTIVE AT of AGREEMENT: <br />12 This AGREEMENT shall be effective upon completion of all of the following.- <br />12 <br />14 1.1 Passage and recording of this PUD AGREEMENT, amending the existing <br />15 Roundy's (RBF LL /I einhart Real Estate Group PIT of January 1, 2000 <br />16' (Ordinance 4 1234), with specific terms and conditions for redevelopment of the <br />17 property. <br />1, <br />19 1.2 Execution of this AGREEMENT by the CITY and the DEVELOPER. <br />20 <br />21 2.0 REQUEST for PUD APPROVAL: <br />22 The DEVELOPER has requested that the CITY approve an amendment to the existing <br />23 Planned Unit Development PUD of January 1, 2000 (Exhibit ) that provides for the <br />2 4 removal of the existing Rainbow Ponds grocery store, former craft store, Roseville 4 <br />25 Theater, and the former Little Caesar's Pizza store southwest corner) and <br />2 6' redeveloping the 7.7 acre property at 1201 — 1211, and 1215 Larpenteur Avenue into a <br />27 0,000+ square foot Rainbow Ponds grocery store that includes a drive -thru pharmacy, <br />28 an open market structure southwest corner) and a small coffee /caf6 type structure /use <br />2 (southeast corner). <br />30 <br />31 The property is legally described as. <br />32 <br />33 See Attachment A. <br />34 <br />35 3.0 PUD APPROVAL: <br />3 6' The CITY hereby grants approval of the amended Planned Unit Development (identified <br />37 as Exhibits A through G in Section 4.0 of this AGREEMENT), subject to the <br />38 LEVEL PER's compliance with the terms and conditions of this AGREEME NT. The <br />39 City agrees to approve applications for building permits, if said applications are <br />4 0 consistent with the plans identified in Section 4.0 below. <br />41 <br />1 <br />
