85 5.0 ZONING: <br />8 6' 5.1 The Roseville Planning Commission conducted a duly noticed public hearing on <br />87 February 6, 2008 pertaining to the Roundy's General Concept Planned Unit Development <br />88 Amendment voting 7-0 to support the request. On February 25, 2008, the Roseville City <br />89 Council approved the General Concept Planned Unit Development Amendment. On <br />90 March 24,, 2008 the City Council approved the Final Development Planned Unit <br />91 Development, subject to the DEVELOPER'S strict compliance with the approved plans, <br />92 and terms and conditions of this AGREEMENT. <br />93 <br />9 4 5.2 The CITY confirms that the zoning of the subject parcels is as follows.- <br />95 <br />9 6' Planned Unit Development with an underlying zoning of Shopping Center <br />97 District (SQ. <br />98 <br />99 5.3 Minor departures from the approved final development plans, which are consistent with <br />100 this AGREEMENT and the underlying Shopping Center District zone and/or the <br />101 Roundy's PUD amendment may be approved by the CITY's Development Review <br />102 Committee and the Community Development Director or designee, as provided in the <br />103 Roseville City Code (Section 1008). Substantial departures from the approved final <br />104 development plans will require an amendment to the Planned Unit Development in <br />105 accordance with Sections 100 6,, 10WP 1010 p 101 and 1015 of the Roseville City Code. <br />106' Where not superseded by more restrictive requirements of this PUD, the standards of the <br />107 underlying zones shall apply, as stated in Chapter 1006 of the Roseville City Code. <br />108 Whether an issue is "minor" or "significant" shall be determined by the CITY as defined <br />109 in Section 1008.09 of the City Code. <br />110 <br />111 6.0 DEVELOPMENT of PROPERTY: <br />112 6.1 <br />The DEVELOPER shall commence and undertake site and structure development <br />113 <br />activities in accordance with the attached plans and maps as identified in Section 4 of this <br />114 <br />AGREEMENT and the terms and conditions identified in Section 9 and 10 of this <br />115 <br />AGREEMENT. Failure to commence an anticipated activity shall not constitute a breach <br />116' <br />or be deemed a violation of this AGREEMENT. The Roundy's Planned Unit <br />117 <br />Development Agreement shall not have a deadline for completion of improvements. <br />118 <br />119 6.2 <br />For purposes of this provision, development activity shall be defined as obtaining a <br />120 <br />building permit, commencing footings and foundations, and continuing with project <br />121 <br />construction on the site. <br />122 <br />123 6.3 <br />Development of the property and installation of public and/or private improvements shall <br />124 <br />be in substantial accordance with all approved plans (attached in this PUD Agreement), <br />125 <br />and/or as approved by the City. <br />12 6' <br />127 <br />
