85 5.0 ZONING: 8 6' 5.1 The Roseville Planning Commission conducted a duly noticed public hearing on 87 February 6, 2008 pertaining to the Roundy's General Concept Planned Unit Development 88 Amendment voting 7-0 to support the request. On February 25, 2008, the Roseville City 89 Council approved the General Concept Planned Unit Development Amendment. On 90 March 24,, 2008 the City Council approved the Final Development Planned Unit 91 Development, subject to the DEVELOPER'S strict compliance with the approved plans, 92 and terms and conditions of this AGREEMENT. 93 9 4 5.2 The CITY confirms that the zoning of the subject parcels is as follows.- 95 9 6' Planned Unit Development with an underlying zoning of Shopping Center 97 District (SQ. 98 99 5.3 Minor departures from the approved final development plans, which are consistent with 100 this AGREEMENT and the underlying Shopping Center District zone and/or the 101 Roundy's PUD amendment may be approved by the CITY's Development Review 102 Committee and the Community Development Director or designee, as provided in the 103 Roseville City Code (Section 1008). Substantial departures from the approved final 104 development plans will require an amendment to the Planned Unit Development in 105 accordance with Sections 100 6,, 10WP 1010 p 101 and 1015 of the Roseville City Code. 106' Where not superseded by more restrictive requirements of this PUD, the standards of the 107 underlying zones shall apply, as stated in Chapter 1006 of the Roseville City Code. 108 Whether an issue is "minor" or "significant" shall be determined by the CITY as defined 109 in Section 1008.09 of the City Code. 110 111 6.0 DEVELOPMENT of PROPERTY: 112 6.1 The DEVELOPER shall commence and undertake site and structure development 113 activities in accordance with the attached plans and maps as identified in Section 4 of this 114 AGREEMENT and the terms and conditions identified in Section 9 and 10 of this 115 AGREEMENT. Failure to commence an anticipated activity shall not constitute a breach 116' or be deemed a violation of this AGREEMENT. The Roundy's Planned Unit 117 Development Agreement shall not have a deadline for completion of improvements. 118 119 6.2 For purposes of this provision, development activity shall be defined as obtaining a 120 building permit, commencing footings and foundations, and continuing with project 121 construction on the site. 122 123 6.3 Development of the property and installation of public and/or private improvements shall 124 be in substantial accordance with all approved plans (attached in this PUD Agreement), 125 and/or as approved by the City. 12 6' 127
