The Vacation Appl ication is actually a re- application -where B o nten. LP, Bon en 11, <br />LC and Boaten V11, LAC (collectively referred to herein as "Bonten"') are applying for the vacation of <br />certain easements in connection with their plat application, which has already been subm.itted to the City. In <br />way of background, the platted property contains the Boniestroo & Associates campus,. as well as certain <br />property owned and, maintained by the City of Roseville. Among other things,, the plat will correct erroneous <br />legal descriptions for the Roseville parcel and surrounding parcels. <br />It is Biontien's 'Intention. to fully vacate certain easements and partially vacate others in connection. on with the <br />plat. 'These vacations have received prior approval from the council, but d-Lie to objections to the process by <br />the Ranisey County Surveyor's office, Bonten is requesting that the City take a second look at the vacations <br />with proper notice. <br />The notice issue especially relates to the partial vacation of St Croix Street, which is governed by Minn. <br />Statute § 412,85 1. Specifically, the vacation of roadway requires a public hearing following ten (10). days <br />NATritten notice to affected property owners. Certified mail is not required by the statute. The notice should <br />contain the legal. descriptions of the property being vacated. <br />I am attaching, the descriptions for easements and roadways to be vacated. Exhibit A is a list of easements to <br />be vacated in their entirety, consisting of storm, water, storm sewer and ponding easements. Exhibit, B lists <br />easements to be partially vacated, including Easement Vacation A,, which. is a storm. flowage easement, and <br />Easement Vacations Bi-1, B-2 and C, which are all partial vacations of St. Croix Street <br />Attached to both the easements to be vacated in their e,ntirety and the easements to be partially vacated are- <br />dra,wings illustrating the easements to be vacated as they relate to the subject property. <br />E-CKBERG.
