<br />5 Request by Bonestroo for approval of a FINAL PLAT and PUBLIC EASEMEW VACATION
<br />at 2335'— 2361 Highway 36 (NOTE: the proposed plat and vacation are strictly internal and
<br />7 would have no impact outside of the property boundaries)
<br />8 Chair Bakeman opened the Public Hearing for Planning File 08-010.
<br />9 Mr. Paschke reviewed the request of Bonten LIP and Boaten 11, LLC, seeking VACATION of
<br />I G certain PUBLIC EASEMENTS (7 storm water pond easements, and 1 sanitary sewer easements
<br />I'll in their entirety and 3 partial easements) and replacing the required utility and drainage
<br />12 easements (as noted on fin-al plat); and seeking approval of the FINAL PLAT (combining 8
<br />3 existing parcels an-d/or lots into 4 new lots,).
<br />14 Mr,. Paschke, detailed the history of the property and certain multiple variances, vacations and.
<br />15 easements, and location of an additional lot for the City's land on which a lift station lies.

<br />161 Staff recommended' APPROVAL of the EASEMENT VACATION and FINAL PLAT request of
<br />17 Bonten LP and Boaten 11 LLC, based on comments and findings of Sections 4 - 6, and subject to
<br />18. the conditions detailed in Section 7 of the Project Report dated March 5, 2008.
<br />Diiscus,s,ion included the timing issues making renewal of this request necessary.
<br />20 Commissioner Boerigter noted that the Request for Plla,nning Commission Action did not include a
<br />21 full copy of the applicant's letter (Exhibit A), with staff requested to provide the full letter in the
<br />22 packet going to the City Council for action.
<br />23 Mr. Pasch�ke apologized for the oversight„ noting that Council action would be in the form of a
<br />24 resolution to (m,ake the approval legat and conforming.
<br />25 At the request of Commissioner Boerigter', Mr. Paschke clarified that the approval was for four (4)
<br />2,6 lots, with three for Bonestro, and 1 lot (Lot 4), owned by the City for the City's lift station and the
<br />27 City's interest in the stormwater pond.
<br />28, Applicant, Jeb Hut zinger, (1650 Highway 36 — 2691 Mp1s,, MN 55401) was present, but
<br />29 iconcurred with staffs report and had no cornment.
<br />30 Chair Bakleman closed the Public Hearing) With no one appearing for or against.

<br />32 Member, Bakeman moved, seconded by Member Martinson to RECOMMEND APPROVAL
<br />33 OF the VACATION of CERTAIN. PUBLIC EASEMENTS, based on the comments of Sections
<br />34 4 and 5,, and subject to the condition of SectJoin 7 of the Project Report dated' March 5,
<br />35, 2008.

<br />40, Member B,akem,an moved, seconded by Member Martinson to RECOMMEND APPROVAL
<br />41 OF the FINAL PLAT, combining eight (8) lots and/or parcels into four (4) lots, based on the
<br />42 comments of Sections 4 and 6, and subject to the condition listed in Section 7 of the
<br />43 Project Report dated March 5, 2008.
