I WHEREAS,, pursuant to Minnesota law, the City has all powers necessary and <br />2 convenient to carry out the redevelopment of the Project Area, including the power of eminent <br />3 domain as provided in Minn. Stat. §§ 465.01, 469.055(8) and Chapter 117; <br />p 1 <br />4 WHEREAS,, the City of Roseville adopted on June 20, 2005, a Restated Development <br />5 Program for Development District No. I commonly known as the "Twin Lakes Project-'7 <br />6 WHEREAS,, the property described on the attached Exhibit A (the "Dorso <br />7 Redevelopment Property") is located within the Twin Lakes Project; <br />8 WHEREAS,, the City adopted its Resolution No. 10367 on December 19, 2005, setting <br />9 forth those properties which it sought to acquire by eminent domain, including the Durso <br />10 Redevelopment Property; <br />11 WHEREAS,, in its Resolution No. 10367,, the City found that it is reasonably necessary, <br />12 proper, and convenient, and in the interest of the public heath, safety, convenience, and general <br />13 welfare,, to acquire the lands,, permanent easements,, temporary construction easements, and other <br />14 rights and interests in order to construct and implement the Project; <br />15 WHEREAS,, in May, 2006, the City did file a Petition in Condemnation in Ramsey <br />16 County to acquire various properties, including the Durso Redevelopment Property; <br />17 WHEREAS,, the District Court for Ramsey County ruled, under District Court File No. <br />18 C3-06-003083,, that (i) the procedures used by the City of Roseville were in accord with the <br />19 statutes governing the acquisition of real property through condemnation; (ii) the City of <br />20 Roseville has all powers necessary and convenient to carry out the redevelopment in the Twin <br />21 Lakes Project, including the power of eminent domain, as provided in Minn. Stat. §§ 465.01, %1.11 <br />22 469.055(8) and Chapter 117; (iii) the acquisition of the properties (including the Redevelopment <br />23 Property) by the City of Roseville served a public purpose in that it permitted the redevelopment <br />2 <br />
