1 <br />2 <br />lls�kspvlffi� <br />Request for Council Action <br />Department Approval <br />Item Description: <br />Date: 07114108 <br />Item: 7.e <br />Manager Approval <br />Worthless Check Program Agreement for the City of Roseville <br />Backswound <br />Financial Crimes Services (FCS) provides an alternative to criminal prosecution of individuals who issue <br />worthless check(s) to merchants and businesses. <br />Financial Crime Services currently has signed agreements and provides services to 84 municipal and 29 county <br />law enforcement agencies in Minnesota including the St. Paul Police Department,, the North St. Paul Police <br />Department, the Maplewood Police Department,, and the Washington County Sheriff's Office. <br />FCS will assist the Roseville Police Department (at no cost to the City) in obtaining records to assist in the <br />investigation and prosecution of individuals issuing worthless checks. FCS will provide that the victim is paid <br />full restitution from the offender who issued the worthless check. FCS will also provide financial education <br />training for the first-time offender. First-time offenders who participate in this program will be diverted from <br />prosecution. FCS will assist the city attorney and victims in obtaining full restitution for victims of NSF checks <br />and account closed checks. <br />FCS will provide the following level of administrative services to the City and offender education classes.- <br />37 Perform daily operations and management of all clerical and accounting functions related to offenders of NSF <br />38 checks to be included in the Roseville Worthless Check Program. <br />39 Generation of demand notices to worthless check writers,, and follow-through with respect to the collection and <br />4O disbursement of victim restitution,, administrative fees,, and FCS education training class fees. <br />41 Provide necessary correspondence and follow-up telephone inquiries to victims and offenders. <br />4 Properly maintain all physical files, financial records, documentation,, reports,, computer files, etc. for a period of <br />43 no more than eight (8) years. <br />44 Provide voluntary (unless mandated by state statutes) worthless check offender financial management education <br />4�5 classes. <br />4�6 Conduct classes designed to teach and provide meaningful information and lessons to offenders on criminal <br />4�7 consequences of Property Crimes, as well as focus on personal management. <br />
