l <br />REQUEST FOR COUNCIL ACTION <br />Date.- 7-21-08 <br />Item No..- 12.a <br />Department Approval City Manager Approval <br />Item Description.- Community Development Department Request to Perform a City <br />Abatement for Unresolved Violations of City Code at 1225 Burke Avenue. <br />I BACKGROUND <br />2 • The current owner is Mr. Anthony M. Delsignore who lives at the property. <br />3 • Notice requesting compliance was sent on June 12, 2008. Because this violation was a danger <br />4 to neighborhood children, a temporary security fence was installed by the City (Immediate <br />Threat,, 407.06.E), on June 24, 2008, due to in-action by property owner. <br />6 • The subject property has four other complaint cases on file since 2005. <br />"7 • Current violations include.- <br />Violation of City Code 906.05B and 905.03.H- <br />9 0 A portion of the swimming pool safety fence has fallen. <br />I Violation of City Code 4�07.02.M.2.- <br />"I'll • Outside storage of lumber. <br />12 A status update, including pictures, will be provided at the public hearing- <br />13 POLICY OBJECTIVE <br />14 The City goals within the Comprehensive Plan are to protect and improve property values (Goal 3, 4, <br />I and 5; page 6 and, Section 3), and to adhere to performance standards which protect the integrity of the <br />I <br />16 housing units and the neighborhood (Policy 6, page 8, Section 3). <br />17 FINANCIAL IMPACTS <br />1111�"`�11 City Abatement.* <br />An abatement would encompass the following <br />20 0 Repair and install the fallen fencing.- <br />2 1 0 Approximately - $,2,000.00 <br />22 0 Remove outside storage of lumber and debris.- <br />23 o Approximately - $,400.00 <br />24 0 Total.- Approximately - $,2,400.00. <br />25 In the short term,, costs of the abatement will be paid out of the HRA budget, which has allocated <br />26 $,100,,000 for abatement activities.
