a) On the Commencement Date,, the Lessee shall pay Owner,, as rent,, the sum of Six
<br />Thousand Four Hundred and No/ 100 Dollars ($6,400.00) per year, in monthly
<br />installments based upon Lessee's installation as shown on Exhibit B, attached hereto.
<br />b), The rent shall be increased annually, commencing upon the commencement date by 3%
<br />per annum.
<br />c), Lessee may not add additional equipment and/or antennas from that shown in Exhibit B
<br />without approval of Owner, which shall not be unreasonably withheld, conditioned or
<br />delayed, and an addendum agreement for additional rent. In the event that Lessee would
<br />like to add one additional antenna,, the rent shall increase to $8,400 per year for three
<br />antennas.
<br />d), If the lease is terminated, rent shall be pro-rated to the termination date.
<br />4. Property Use. Lessee may use the property for the purpose of operating a
<br />communications facility, and for the installation, operation, and maintenance of facilities for the
<br />transmission and reception of radio communication signals in such frequencies as may be
<br />assigned to Lessee by the Federal Communications Commission the "FCC"'), and for the storage
<br />and use of related equipment in accordance with the terms of this Lease. This use shall be non-
<br />exclusive,, except that Lessee's tower space and ground space shall be exclusively for Lessee's
<br />use. Lessee shall use the property in compliance with all federal, state, and local laws and
<br />regulations. Owner agrees to reasonably cooperate with Lessee in obtaining, at Lessee's
<br />expense, including Owner's reasonable attorney and administrative fees, any federal licenses and
<br />permits required for Lessees use of the property.
<br />5. Installation of Equipment and Leasehold IMprovements.
<br />a), Lessee shall have the right,, at its sole cost and expense, to erect, install, operate, and
<br />maintain in accordance with good engineering practices, with all applicable FCC rules and
<br />regulations, on the property, the necessary equipment, personal property, and facilities
<br />which include radio transmitting and receiving antennas not to exceed that designated in
<br />Exhibit B (the "Antenna Facilities"') I .
<br />b), Lessee's installation of all such Antenna Facilities shall be done according to plans
<br />approved by Owner, which approval shall not unreasonably be withheld, conditioned or
<br />delayed. Owner shall approve or object to such plans within thirty (30), days of receipt,
<br />and failure to make any objection within said thirty (30), days shall be deemed approval by
<br />Owner. Any damage done to Owner's property during installation or operations itself
<br />during installation and operations shall be repaired or replaced at Lessee's expense and to
<br />Owner's reasonable satisfaction.
