significance. As for the title company's reference to the deeds as easements, their rationale is
66 not provided' and none is apparent.
67 5.4 Based upon the legal opinion of the City Attorney, the City is unable to vacate an easement that
68 does not exist and will return the applicants Vacation Application.
69 5.5 Staff will recommend that the land area identified in Document No. 1511184 and lying within
"7 ('-) the proposed Lot I,, be dedicated as right-of-way on the plat.
71 6.0 REVIEW OF SUBDIVISION PLAT
"7 2 6.1 The subject property has been combined into one parcel for tax purposes. The underlying land
"7 3 consists of 6 lots (Lots 1, 2, 3, 18, 19, and 20, Block B, Twin View)l, platted in 1925, and the
74 applicant desires to replat the 6 lots into I lot and I outlot. City Code requires a re-platting
"7 when creating new lots.
'7 6 6.2 Lot L Block L of the proposed Twin Lakes Addition would be a 1.2-acre lot (and the possible
'7 "7 future site of the Metro Transit park-and-ride facility, if approved )l. The 3.83-acre Outlot will
'7 8 be for a future redevelopment and would require future re-platting in order to allow structures
79 on the premises.
o
6.3 Typically, City Code would require a 12-foot-wide utility and drainage easement centered on
the outer boundaries of all new lots. However,, City Staff has determined that no such
easements are necessary on Lot 1. The City will require the possible future dedication of utility
3
and drainage easements on the Outlot once development and re-platted is proposed.
84 6.4 A review of the right-of-way necessary for Cleveland Avenue concluded that an additional 10 is
necessary. City Staff will also require the dedication of right-of-way (10-foot wide strip), for
6
Iona Lane and Mount Ridge Road, but only that which lies on Lot 1. The City will defer the
"7
dedication of additional right of way needs until the Outlot is re-platted.
88 7.0 STAFF COMMENTS AND RECOMMENDATION
89 7.1 The Planning Division recommends approval of the PRELIMINARY PLAT,, subject to the
90 following conditions
9111 a. The PRELIMINARY PLAT shall be revised to account for the change in land area based
92 upon Quit Claim Deed 1511814; shifting the Outlot and Lot 1 10 feet west and 10 feet
93 south.
94 b. The applicant shall dedicate as right-of-way the 10 foot wide strip (Iona Lane and Mount
95 Ridge Road), identified in Document 1511814 on the proposed Lot I only.
96 C Future right-of-way dedications and utility and drainage needs will be considered at the
97 time the Outlot is re-platted.
98 d. The re-platting of Lots 1, 2, 3, 18, 19, and 20, Block B, Twin View may require park
99 dedication consistent with State Statutes 462.358 and § 1103.07 of the Roseville City
Code.
