42 <br />5. <br />Prepare required TBRA grant periodic status reports,, final report, and certificate of <br />43 <br />expenditures, pursuant to Metropolitan Council requirements for review and submittal by the <br />44 <br />city. <br />45 <br />6. <br />Provide to the City, for City use, copies of all environmental documents and reports created <br />46 <br />or obtained in the course of undertaking the work set forth in the grants. <br />47 <br />7. <br />If the project changes from that which was described in the grant application, provide the <br />48 <br />City with a written description of the proposed changes and implications of these changes to <br />49 <br />grant funded activities. <br />50 <br />8. <br />Submit a written explanation to the City if TBRA grant funds cannot be expended within the <br />51 <br />timeframe of the grant agreements. <br />52 <br />53 <br />D. <br />BOTH PARTIES SHALL.- <br />54 <br />55 <br />1. <br />MODIFICATION. Modifications within the scope of the instrument shall be made by <br />56 <br />mutual consent of the parties, by the issuance of a written modification, signed and dated by <br />57 <br />all parties, prior to any changes being performed. <br />58 <br />59 <br />2. <br />PARTICIPATION IN SIMILAR ACTIVITIES. This instrument in no way restricts the <br />60 <br />Developer from participating in similar activities with other public or private agencies, <br />61 <br />organizations, and individuals. <br />62 <br />63 <br />3. <br />TERMINATION. Any of the parties, in writing, may terminate the instrument at any time <br />64 <br />before the date of expiration. <br />65 <br />66 <br />4. <br />COMMENCEMENVEXPIRATION DATE. This instrument is executed as of the date of <br />67 <br />last signature and is effective through June 30, 2010, at which time it will expire unless <br />68 <br />extended. <br />69 <br />ON <br />
