74 Planned Unit Development (PUD) with an underlying zoning of Limited Business <br />75 (B-1) District. <br />76 5.2 The CITY agrees to rezone the subject property to Planned Unit Development <br />77 (PIED) with an underlying zoning of Limited Business (B-1) District, subject to <br />78 the DEVELOPER'S strict compliance with the approved plans, and the terms and <br />79 conditions of this agreement. Where not superseded by more restrictive <br />80 requirements of this PUD, the standards of the underlying Limited Business (B-1) <br />81 zoning district shall apply, as stated in Chapter 1005 of the Roseville City Code. <br />82, 6.0 Development of Property <br />83 6.1 Failure by the DEVELOPER to commence development activity in accordance <br />84 with the final development plans or within one year following the final approval <br />85 of this Planned Unit Development, will necessitate the approval of an extension of <br />86 the development schedule by the City Council prior to the expiration of the one <br />8 7' year period. If an extension is not applied for, the Council may instruct the <br />88 Planning Commission to initiate rezoning to the underlying B-1 zoning district. <br />89 For purposes of this provision, development activity shall be defined as obtaining <br />90 a building permit and beginning construction on the site. <br />91 6.2 Development of the property and installation of improvements shall be in <br />92, accordance with the development schedule provided by the DEVELOPER and <br />93 approved by the CITY (Exhibit H). <br />94 6.3 Minor deviations from the approved final development plans, which are <br />95 consistent with this agreement and the underlying B- I zoning district, may be <br />96 approved by the CITY's Development Review Committee, under the direction of <br />9 7' the Community Development Director. Substantial departures from the approved <br />98 final development plans will require an amendment to the Planned Unit <br />99 Development in accordance with Section 1015 of the Roseville Zoning <br />100 Ordinance. <br />l o l 7.0 Compliance with Laws and Regulations <br />102, The DEVELOPER represents to the CITY that any site improvements pursuant to the <br />103 proposed development will comply with all City, County, Regional, Metropolitan,, State,, <br />104 and Federal laws and regulations, including but not limited to the Roseville Zoning <br />105 Ordinance. <br />X106 8.0 Site Development Requirements <br />10 7' To ensure that the proposed development meets the CITY'S requirements and standards <br />108 for site development, the following provisions shall apply.- <br />109 8.1 Erosion Control.- Before site grading and before any utility construction is <br />110 commenced or building permits are issued, an erosion control plan must be <br />ill submitted for approval, and all erosion control actions shall be implemented, <br />112, inspected, and approved by the CITY (Exhibit Q. <br />113 8.2 Final Grading Plan.- The final grading plan for the property must be reviewed and <br />114 approved by the Director of Public Works prior to any permits being issued for <br />115 the building addition.
