<br />38 In approving the final development plan for the PUD for the DEVELOPER,, the CITY
<br />39 hereby incorporates the following exhibits. The DEVELOPER shall develop the subject
<br />40 property as described or shown in these exhibits. If the exhibits vary from the written
<br />41 terms of this Agreement,, the written terms shall control. In the event the exhibits address
<br />42, items not specifically addressed in this agreement, the exhibits shall govern with respect
<br />43 to those items. The exhibits as approved by the City Council on September 15, 2008, or
<br />44, as amended thereafter, shall include.-
<br />45 Exhibit A Certificate of Survey indicating existing site conditions with all lot dimensions
<br />46 dated April 23, 2004

<br />49 setbacks,, dated,, June 21, 1999 and revised

<br />51 addition,, all grade contours with spot elevations, sanitary sewer and watermain
<br />52, service,, catch basins for surface water catchment,, existing utilities, and all erosion
<br />53 control measures to be utilized during construction, dated August 22, 2008
