Attachment E <br />1 CITY of ROSEVILLE <br />2 PLANNED UNIT DEVELOPMENT AGREEMENT # <br />3 <br />4 This PLANNED UNIT DEVELOPMENT AGREEMENT ("AGREEMENT" , dated <br />5 September 15, 2008 is entered into between the City of Roseville, a Minnesota municipal <br />6' corporation, of 2660 Civic Center Drive, Roseville, Minnesota 55113 ("CITY"') and United <br />7 Properties, 3500 American Boulevard West, Suite 200, Bloomington, MN 554 1 <br />8 ("DEVELOPER"'). For reference the City of Roseville project file is PF07-006. <br />9 <br />10 1.0 EFFECTIVE DATE of AGREEMENT: <br />11 This AGREEMENT shall be effective upon completion of all of the following.- <br />12 <br />13 1.1 Passage and submission for recording (County receipt) of Applewood Pointe of <br />14 Langton Lake, the required subdivision plat for the property with the Ramsey <br />15 County Recorder. <br />16' <br />17 1.2 Passage and publication of Ordinance 4 rezoning the property from <br />18 Single Family Residence District (R-1) to Planned Unit Development (PUD) with <br />19 an underlying zoning of General Residence District (R-3). <br />20 <br />21 1.3 Execution of this AGREEMENT by the CITY and the DEVELOPER. <br />22 <br />23 2.0 REQUEST for PUD APPROVAL: <br />2 4 The DEVELOPER has requested that the CITY approve an 6.5 acre redevelopment <br />25 consistent with the Roseville Comprehensive Land Use Plan and the Twin Lakes <br />2 6' Master Plan into a Planned Unit Development (PUD), that includes a 4-story, 95 unit <br />27 age restricted senior cooperative. <br />28 <br />29 Upon recording the property is legally described as.- <br />30 <br />31 Lot I and Lot 2, Block 1, Applewood Pointe of Langton Lake <br />32 <br />33 3.0 PUD APPROVAL: <br />3 4 The CITY hereby grants approval of the amended Planned Unit Development (identified <br />35 as Exhibits A through I in Section 4.0 of this AGREEMENT), subject to the <br />3 6' DEVELOPER's compliance with the terms and conditions of this AGREEMENT and <br />37 any and all applicable requirements of Title 10 of the Roseville City Code, unless <br />38 otherwise identified herein. The City agrees to approve applications for building permits, <br />39 if said applications are consistent with the plans identified in Section 4.0 below. <br />40 <br />4 1 For any improvements not contemplated in this AGREEMENT, the CITY may require <br />4 2 compliance with any amendments to the Comprehensive Guide Plan, official controls, <br />4 3 platting or dedication requirements enacted after the date of this AGREEMENT. <br />1 <br />
