3.1 Periodically the Community Development Department staff reviews code violations relating to residential City Codes to determine whether there are properties in violation for an extended period. Staff attempts to gain compliance during this time on these properties. Generally they have not met the Code because the owner has been unable (physically or financially) or unwilling to comply with the code. 3.2 A Ramsey County Court Citation is one remedy. It allows an impartial third party (Ramsey County judge) to assess the situation and make a ruling. The Community Development Department anticipates a judge will require the property owner to bring the property into code compliance and require no other violations over the next 12 months. This process has been successfully used in previous years to resolve nuisance complaint violations. 3.3 Staff continues to encourage property owners to gain compliance up to the time of a Council hearing. 4.0 POLICY IMPLICATIONS 4.1 The City Code requires that each time a court citation is considered (to resolve a public nuisance case) that City Council review and approve the issuance prior to authorizing staff to proceed. 4.2 The City goals within the Comprehensive Plan are to protect and improve property values (Goal 3, 4 and 5; page 6 and, Section 3), and to adhere to performance standards which protect the integrity of the housing units and the I neighborhood (Policy 6, page 8, Section 3). 5.0 STAFF RECOMMENDATION 5.1 Staff recommends that the Council direct the staff to work with the City Attorney to cite (Ramsey County Court Citation) the owner of 1715 Roselawn Ave. for violations of the City Code. 6.0 SUGGESTED COUNCIL ACTION 6.1 By motion, direct staff to work with the City's Prosecuting Attorney to cite (Ramsey County Court Citation) the owner for violations of the City Code.
