3.1 Periodically the Community Development Department staff reviews code <br />violations relating to residential City Codes to determine whether there are <br />properties in violation for an extended period. Staff attempts to gain compliance <br />during this time on these properties. Generally they have not met the Code <br />because the owner has been unable (physically or financially) or unwilling to <br />comply with the code. <br />3.2 A Ramsey County Court Citation is one remedy. It allows an impartial third party <br />(Ramsey County judge) to assess the situation and make a ruling. The Community <br />Development Department anticipates a judge will require the property owner to <br />bring the property into code compliance and require no other violations over the <br />next 12 months. This process has been successfully used in previous years to <br />resolve nuisance complaint violations. <br />3.3 Staff continues to encourage property owners to gain compliance up to the time of <br />a Council hearing. <br />4.0 POLICY IMPLICATIONS <br />4.1 The City Code requires that each time a court citation is considered (to resolve a <br />public nuisance case) that City Council review and approve the issuance prior to <br />authorizing staff to proceed. <br />4.2 The City goals within the Comprehensive Plan are to protect and improve <br />property values (Goal 3, 4 and 5; page 6 and, Section 3), and to adhere to <br />performance standards which protect the integrity of the housing units and the <br />I <br />neighborhood (Policy 6, page 8, Section 3). <br />5.0 STAFF RECOMMENDATION <br />5.1 Staff recommends that the Council direct the staff to work with the City Attorney <br />to cite (Ramsey County Court Citation) the owner of 1715 Roselawn Ave. for <br />violations of the City Code. <br />6.0 SUGGESTED COUNCIL ACTION <br />6.1 By motion, direct staff to work with the City's Prosecuting Attorney to cite <br />(Ramsey County Court Citation) the owner for violations of the City Code. <br />RCA1715RoseCtCit 2 2 5 08.doc.doc Page 2 of 9 <br />
