REQUEST FOR CITY COUNCIL ACTION <br />Department ApprovaL <br />PT/DM/RT <br />City Mania per Approval.- <br />DATE.- 02 25 08 <br />ITEM NO.- 13.b <br />Agenda Section.- <br />BUSINESS ITEMS <br />Item Description.- Community Development Department request to issue a <br />Ramsey County Court Citation for violation of Roseville City <br />Code at 2256 Lexington Ave N. <br />14 1.0 REQUESTED ACTION: <br />Council action is necessary to resolve a nuisance violation located at 2256 <br />Lexington Ave N. The property is owned by Gerald Helgason and <br />Kathleen Helgason. The owner has been notified of this agenda item and <br />this meeting. <br />2.0 PROJECT HISTORY: <br />2.1 The home at 2256 Lexington Ave N. is owned by Gerald Helgason and <br />Kathleen Helgason who do not live in the home. <br />22 Wayne Helgason has stated that he is renting this property to recovering <br />chemically dependent individuals as a service to the community. <br />2.3 Staff performed an on-site inspection on 6 2107 and after speaking with a <br />resident ascertained that 7 to 8 men resided at the house. The owner was <br />notified on July 12, 2007, that the maximum number of renters allowed in <br />a single-family house is four (Sections 1004.02 A and 1002.02). <br />2.4 The property owner was notified that one possible option available to him <br />(them) was to become a properly licensed Chemical Dependency facility <br />through the State of Minnesota Chemical Health Division or to become a <br />Residential Treatment Care facility that would allow for a maximum of 6 <br />residents to be housed in an RI district. <br />2.5 The property owner has not licensed the residence and is renting to more <br />than 4 individuals. <br />2.6 The property is currently in violation of City Code Sections 1004.02A and <br />1002.02. <br />3.1 Periodically the Community Development staff reviews code violations <br />relating to property use to determine whether there are properties in <br />violation for an extended period. The staff spends time attempting to gain <br />compliance during this time on these properties. Generally they have not <br />met the Code because the owner has been unable (physically or <br />financially) or unwilling to comply with the Code. A Ramsey County <br />
