Court Citation is one remedy. It allows an impartial third party (Ramsey <br />County judge) to assess the situation and make a ruling. The Community <br />Development Department anticipates the judge will require the property <br />owner to cease from practice of renting his property to more than four (4) <br />unrelated adults at a time. <br />32 This same process has been successfully used by the City in resolving <br />overcrowding issues in RI districts. In one of those previous cases the <br />Ramsey County judge found in favor of the City, ordered the homeowner <br />to make corrections and allowed for the City to have periodic inspections <br />to insure compliance. <br />3.3 The staff attempts to work with property owners to urge compliance with <br />residential zoning ordinances (and continue to encourage property owners <br />to maintain properties up to the time of a Council hearing). <br />4.0 POLICY IMPLICATIONS: <br />4.1 The Council has requested that each time a county court citation is <br />considered to resolve a land use case,, the Council reviews the case and <br />provides direction prior to authorizing the city prosecuting attorney to <br />proceed. <br />4�.2 The City goals within the Comprehensive Plan are to protect and improve <br />property values (Goal 3, 4 and 5; page 6 and, Section 3), and to adhere to <br />performance standards which protect the integrity of the housing units and <br />the neighborhood (Policy 6, page 8, Section 3). <br />5.0 STAFF RECOMMENDATION: <br />5.1 Staff recommends that the Council direct the staff to work with the city <br />prosecuting attorney to cite (Ramsey County Court Citation) the owner for <br />the specific violations of the Code. <br />5.2 Other options include.- 1), Administrative ticket—Staff does not feel that <br />this step would be effective. <br />6.0 SUGGESTED COUNCIL ACTION: <br />6.1 By motion, direct the staff to work with the city prosecuting attorney <br />to cite (Ramsey County Court Citation) the owner of 2256 Lexington <br />Ave. N. for violation of City Code Sections 1004.02A and 1002.02. <br />
