Draft Planning Commission Minutes Attachment D <br />PLANNING FILE 08-004 <br />Request by Snelling Liquor for a CONDITIONAL USE PERMIT to allow an off-sale liquor store in <br />3 the existing building at 221�7 Snelling Avenue <br />Chair Bakernan opened the Public Hearing for Planning File 08-004. <br />5 Mr. Lloyd reviewed the request of Steve Allen, in conjunction with property owners Clifford and Marylin <br />6 Snyde'r for approval of a CONDITIONAL USE PERMIT (CUP) to allow a 1,800 square foot, off-sale liquor <br />7 store, d/b/a Snelling Liquor, in the existing building at 221�7 Snelling Avenue. <br />8 Mr. Lloyd noted the different City Code definitions and requirements for stand-alone versus those liquor <br />C/', stores located within a shopping ce'nte'r building; and briefly reviewed applicable CUP crite'ria, or <br />10 proposed conditions of approval. <br />"I'll Staff recommended APPROVAL of the CUP for Steve Allen for a proposed off -sale liquor store at 221�7 <br />I r <br />?, Snelling Avenue, to operate in compliance with requirements and regulations established in Roseville City <br />13 Code, Section 1004-01G; and based on comments and findings of Sections 5 and 6 of the project report <br />1 dated February 6, 2008. City Code, Section 302, related to operations of a liquor store was referenced by <br />15 staff. <br />16 Commissioner Gasongo noted the re'ce'ntly-approve'd application for the apartment building improvements <br />17 to the north, and questioned the impact of this land use on those neighborhood improvements and market <br />1 values. <br />1 Mr. Lloyd advised that this improvement would eliminate vacant space', and had not be'e'n reviewed for <br />(1210 impacts to market value of adjoining prope'rtie's, as beyond the scope of the land use conside'ration, with <br />"I", <br />r <br />I this use recognized as compatible in the Comprehensive Plan. <br />Commissioner Boerigter questioned whether the Commission was to consider City Code Section 302-02 <br />302.13d, or if those were for the City Council's conside'ration in issuing a liquor lice'nse'. <br />Mr. Lloyd advised that the Code Section was included only for informational purposes for the Commission <br />4-1 <br />"1"?15 to be aware of off-sale liquor store operations, and that staff was not indicating any additional conditions <br />'21 <br />to this use for Commission application. <br />!1- 7 Discussion included xt rior elevations of the building and the desire of the Commission for <br />(1`N11`. ""11'111 iimprove'me'nts; future sign pe'rmit as pe'r code' ; additional landscaping ame'nitie's; fe'ncing be'twe'e'n the <br />subject and neighboring residential property as per code requirement; softening the impact to adjacent <br />30 prope'rtie's through additional gre'e'n space or scre'e'ning; and limitations to site conditions based on inside <br />3 "1 activities related to the CUP. <br />31"1"?, Additional discussion included communication with ne'ighbors to-date', with Mr. Lloyd advising he had <br />33 receive one (1 phone call from the residential property owner on the west, concerned with loitering of <br />3,`,1 clientele using the facility, indicating that more residents of the building shared those concerns. Howe've'r, <br />35 Mr. Lloyd advised that staff had re'ce'ive'd no othe'r communications to-date', with the exception of a query <br />36 from a resident se'e'king how to contact the Planning Commission, and how to receive additional <br />37 information on the application. <br />38 Commissioners Boe'rigte'r and Wozniak advised that they had re'ce'ive'd se've'ral e' -mail objections to the <br />proposal, based on perceived negative impacts of liquor store activities. <br />,,,`,10 Staff noted that the applicant was not present. <br />1 Public Comment <br />Deedee Goodwin, 2206 Haddington Road <br />,13 Ms. Goodwin re'fe're'nce'd Section 6.6 of the staff report re'late'd to the project's impact on the ge'ne'ral <br />public health, safety and welfare; and addressed the project's proximity to parks, specifically Brimhall <br />15 School and Evergreen Park. Ms. Goodwin challenged the staff re port's statement that the site was ov r 1/2 <br />16 mile from the school and park; and opined that the liquor store would have a detrimental impact on the <br />,17 neighborhood that was already experiencing a serious drug problem. Ms. Goodwin addressed her work <br />history in corrections; ATF activity in the Haddington Road area in the past; and impacts to the <br />neiighborhood from the recently-enlarged Target store and historical patterns of crime following big box <br />5c) retail ce'nte'rs. Ms. Goodwin asked that the Commission conside'r the affects of a liquor store on the <br />
