2 6.15 § 1006.05A3 (Special Requirements When Rear Yard Includes Loading Area) states.- <br />3 Where a rear yard of a shopping center district includes the loading and servicing area <br />4 of a shopping center building and where such a rear yard is adjacent to or across the <br />5 street from a residential district, the building setback shall be one hundred twenty feet <br />6 <br />(12,0 �, and the buffer strip shall be sixtyfeet (60��. <br />7 <br />8 Given the complexities in locating the new store (addressed above) it would be <br />9 nearly impossible to achieve full compliance with these requirements and still <br />10 construct an efficient site and store. The Planning Division has concluded that <br />I I requiring an additional buffer and setback is impractical and that the impact of the <br />12 new store and drive lane, though in a very similar location to the existing condition, <br />13 can be mitigated by the inclusion of landscape, specifically coniferous trees <br />14 (evergreens) on the slope. <br />15 <br />16 6.16 § 1006.05B (Floor Area Ratio) states.- Ratio between floor area of building and lot area <br />17 exclusive ofpublic right-of-way easements, shall not be greater than 1. Q, except as <br />18 approved in the project master plan or a site specific Planned Unit Development. <br />19 <br />20 The Round 's has a parcel size of 335,897 sq. ft. (7.7 acres) and would be comprised <br />21 of approximately 65,000 sq. ft. in structure footprints for a floor area ratio of 0.19. <br />22 <br />23 6.17 § 1006.05C (Building Height) states.- Building height shall be limited to three (3) stories <br />24 above the main entry or first floor grade (as defined in the approved project master plan <br />25 or the Planned Unit Development for the site. In no event shall a building exceed thirty <br />26 five feet (35) in height above the main entry or first floor grade level (as defined in the <br />27 approved project master plan or the Planned Unit Development for the site) or as <br />28 amended through a Planned Unit Development. <br />29 <br />30 In review of the proposal, the elevation drawing indicates a structure height of 40 <br />31 feet at the entry feature. This height is due to the inclusion of design improvements <br />32 necessary to address building mass and to give the structure character. The 40 foot <br />33 height would be located at the entry element of the structure and does not appear to <br />34 be significantly tall compared to the rest of the structure. The Planning Division <br />35 and TALC' staff supports the proposed height increase to that specific portion of the <br />36 structure. Limiting the height would eliminate the creative solutions staff has <br />37 sought for this site and the structure in particular. <br />38 <br />39 6.18 §1006.05D (Traffic) states.- The site plan shall provide vehicular circulation routes away <br />4O f o resi en ial areas and avoid commercial vehicle ingress and egress o local <br />41 residential streets to commercial property sites. In the site plan review and approval <br />4 process, every reasonable effort must be made to design the site circulation so that <br />43 service vehicles over one ton capacity do not use routes which bring vehicles between a <br />44 building and a residential district boundary. The site plan shall also provide pedestrian <br />45 access routes using walks or paths, including where practical, connections to adjacent <br />4 residential areas.
