Attachment J <br />I PUBLIC IMPROVEMENT CONTRACT <br />2 JO�VEPHINE WOORY <br />3 <br />4 I. Parties. This Agreement, dated 011, is entered into between the City of <br />5 Roseville,, a Minnesota municipal corporation, 2660 Civic Center Drive,, Roseville,, Minnesota <br />6 55113 ("the City"')�, and Pulte Homes of Minnesota LLC, a Minnesota Limited Liability <br />7 Company ("the Developer"')�. <br />8 It Request for Plat approval. The Developer has asked the City to approve a plat of land to be <br />9 known as "Josephine Woods " (also referred to in this Agreement as the "Plat"'). The land is <br />10 legally described as follows.- <br />I I See Legal Description attached as Exhibit A hereto (the "Property"). <br />12 <br />13 111. Terms and Conditions of Plat Approval. Now, therefore, in reliance upon the representations <br />14 contained herein,, and in consideration of the mutual undertakings herein expressed, the parties <br />15 agree as follows.- <br />16 A. Conditions of Plat Approval: The City hereby approves the Plat on the condition that.- <br />A <br />17 A. The Developer enter into this Agreement, and <br />18 <br />19 B. The Developer provide the necessary security in accordance with this Agreement. <br />20 <br />21 B. Land Use Approvals.- The Plat consists of 28 single-family lots. The Property is to be improved <br />22 with the following.- pathways; a road and curbing; a storm water pond; infiltration basins; sanitary <br />23 sewer lines,, water main lines and hydrants, storm sewer lines with outlet control structures and <br />24 flared end sections,, fences,, and retaining walls. <br />25 C. Public Improvements. The Developer shall, subject to the terms and conditions contained herein, <br />26 perform the following work and construct the following improvements ("Public Improvements") in <br />27 compliance with City approved plans and specifications described in Section III D below and all <br />28 rules,, regulations, standards and ordinances of the City.- <br />29 <br />1. Site Grading and Turf Restoration. The Developer shall grade the Property in accordance <br />30 <br />with the City approved Grading, Drainage and Erosion Control Plan. Site grading <br />31 <br />improvements shall include common excavation, sub grade correction, embankment and <br />32 <br />pond excavation. Turf restoration shall include seeding, mulching and erosion control. <br />33 <br />a) The Developer shall submit to the City a site grading and drainage plan for the entire <br />34 <br />Plat acceptable to the City showing the grades and drainage for each lot prior to <br />35 <br />installation of the improvements. <br />36 <br />b) The Developer shall furnish the City Engineer satisfactory proof of payment for the <br />37 <br />site grading work and shall submit a certificate of survey (as- constructed survey) of the <br />38 <br />development to the City after site grading, with street and lot grades. <br />39 <br />c) All improvements to the lots and the final grading shall comply with the approved <br />40 <br />grading plan. <br />41 <br />2. Street Improvements. The Developer shall construct all streets shown on the Plat in <br />42 <br />accordance with the Public Improvement Construction Plans.
