Attachment J <br />1 <br />35% of the cost of designing and reconstructing the new lift station. At this time, the <br />2 <br />estimate for this work is $,200,,000. The Developer's estimated cost share is $,70,000. If <br />3 <br />there is a difference between the estimated cost and the actual cost,, the actual cost shall <br />4 <br />control. The full amount of the Developer's cost share shall be due to the City when the <br />5 <br />contract for the lift station reconstruction work is awarded. <br />6 <br />c) <br />7 <br />6. Storm sewer construction.- The Developer shall construct all storm sewer improvements <br />8 <br />determined to be necessary by the City to serve the Property, including the construction <br />9 <br />of outlet control structures and flared end sections. <br />10 <br />a) Storm sewer facilities, including ponds and infiltration basins, shall be constructed in <br />I I <br />accordance with City details and specifications and as shown on and in accordance with <br />12 <br />the City approved Public Improvement Construction Plans. <br />13 <br />b) Infiltration basins shall be protected from silt during construction. If these areas do <br />14 <br />not function as designed, the Developer shall reconstruct them as directed by the City <br />15 <br />Engineer. <br />16 <br />7. Restoration of existing streets.* Curb cuts and street cuts shall be reconstructed to match <br />17 <br />existing street typical section. <br />18 <br />a) All unused curb openings along County Road C-2 shall be removed and replaced with <br />19 <br />non- surmountable curb to match existing. Curbs proposed to be replaced shall have a <br />20 <br />minimum of 3 feet of bituminous saw cut out to allow for proper compaction. <br />21 <br />b) Utility trenches shall be restored by the Developer per City standard details. <br />22 <br />23 <br />8. Contaminated soil remediation.- Contaminated soil encountered during the construction <br />24 <br />of the development shall be removed from the right-of-way and easements. The soil shall <br />25 <br />be disposed of at an off-site location approved by the City. <br />26 <br />9. Erosion control. Prior to any grading and before any utility construction is commenced <br />27 <br />or building permits are issued, the erosion control plan shall be implemented, inspected <br />28 <br />and approved by the City. The Developer shall meet all requirements of the City's <br />29 <br />Erosion Control Ordinance including but not limited to the following.- <br />30 <br />a) No construction activity shall be allowed and no building permits shall be issued <br />31 <br />unless the Property is in full compliance with the erosion control requirements. <br />32 <br />b) Measures shall be installed in compliance with MPCA NPDES permit requirements. <br />33 <br />c) The City shall inspect the site periodically and determine whether it is necessary to <br />34 <br />take additional measures to address erosion. <br />35 <br />d) To remove dirt and debris from streets that has resulted from construction work by <br />36 <br />the Developer, its agents or assigns, the Developer shall sweep County Road C-2 and <br />37 <br />Fernwood Street on a weekly basis or more frequently as directed by the City Engineer <br />38 <br />until the site is stabilized. Developer must sweep roadways with a water-discharge <br />39 <br />broom apparatus. Kick-off brooms shall not be utilized for street sweeping. <br />40 <br />e) If the development on the Property does not comply with the erosion control plan or <br />41 <br />supplementary instructions received from the City, the City may, following giving the <br />Page 3 of 15 <br />
