Attachment J <br />1 4. Site Maintenance. The Developer shall ensure the contractor maintains a clean work site. <br />2 Measures shall be taken to prevent debris, refuse or other materials from leaving the site. <br />3 Construction debris and other refuse generated from the project shall be removed from <br />4 the site in a timely fashion and/or upon the request by the City Engineer. After the <br />5 Developer has received twenty-four (24) hour verbal notice, the City may complete or <br />6 contract to complete the site maintenance work at the Developer's expense. <br />7 5. Cold Weather Construction. The City requires that no public concrete or bituminous <br />8 infrastructure be constructed on or within frozen ground. Upon evidence of frozen <br />9 ground in the project aggregate base/subgrade and all concrete and bituminous work shall <br />10 cease for the construction year. No bituminous base paving or concrete pouring will be <br />I I allowed after November I't of the calendar year. Work may be performed after <br />12 November I't only with the approval of the City Engineer, and if permitted such work <br />13 shall comply with City specifications. <br />14 6. Bituminous and Concrete Material Acceptance. The City shall not accept concrete curb <br />15 and gutter that has structural or cosmetic defects. The City shall identify all defective <br />16 curb for removal. The City shall not accept bituminous base course with less than 91.5% <br />17 density or that has an open graded appearance as determined by the City Engineer. This <br />18 is considered to be rejected and shall be required to be removed at the Developer's <br />19 expense. At no time shall the bituminous wear course be installed after September I't of <br />20 any calendar year or prior to weight restrictions being lifted in the spring. <br />21 7. Televising. All storm sewer and sanitary sewer shall be televised, at the Developer's <br />22 expense,, prior to the installation of the aggregate base, concrete curb and gutter, and <br />23 bituminous. The City shall review and approve the televising tapes prior to <br />24 commencement of the roadway construction. All televising media shall be submitted on <br />25 DVD. <br />26 8. Project Identification Signage. Project identification signs shall comply with City Code <br />27 Re, ulations. <br />28 R. Certificate of Insurance. The Developer shall take out and maintain until one year after the City <br />29 has accepted the Public Improvements, workers compensation and general liability insurance <br />30 satisfactory to the City covering personal injury, death, and claims for property damage which may <br />31 arise out of the Developer's work, the work of its contractors and subcontractors, or by anyone <br />32 directly or indirectly employed by any of them. Limits for bodily injury or death shall be not less <br />33 than $,1 500,,000.00 for each occurrence and limits for property damage shall be not less than <br />34 $,300,,000.00 for each occurrence. The City shall be named as an additional insured on the general <br />35 liability policy. The Developer shall provide the City with a certificate of insurance, satisfactory to <br />36 the City, which evidences that it has such insurance in place prior to the commencement of any work <br />37 on the Property and a renewal certificate at least 30 days prior to the expiration date of any policy <br />38 required hereunder. <br />39 S. All Costs Responsibility of Developer. The Developer shall pay all costs incurred by it and the <br />40 City in conjunction with this Agreement, the approval of the Plat, the development of the Property, <br />41 and the construction of the improvements required by this Agreement, including but not limited to, <br />42 all costs of persons doing work or furnishing skills, tools, machinery and materials; insurance <br />43 premiums; Letter of Credit fees; legal, planning and engineering fees; the preparation and recording <br />I 1 9 1 <br />44 of this Agreement and all easements and other documents relating to the Plat and the Property; and <br />Page 8 of 15 <br />
