Attachment K <br />34 NOW,, THEREFORE,, BE IT FURTHER RESOLVED that.- <br />35 1. The Roseville City Council finds that the easement vacation has no relationship to <br />36 the City's Comprehensive Plan and therefore the Roseville City Council has <br />3 7' dispensed with the requirements of Minnesota Statutes §4� 2.35 , Sub d. 2; <br />38 2. The vacation applies only to that portion of the public storm sewer easement <br />39 legally described above and not.- (a) the rights of other existing utilities, if any, as <br />40 provided in Minnesota Statutes § 161.45, Subd. 3, or (b) any other easements <br />41 running to or benefitting the City of Roseville; and <br />42, 3. The City Manager is directed to record a notice of completion of these vacation <br />43 proceedings pursuant to Minnesota Statutes §4 12.851. <br />44 The motion for the adoption of the foregoing resolution was duly seconded by Council <br />45 Member and upon vote being taken thereon, the following voted in favor.- <br />A <br />46 and voted against. <br />4`7 WHEREUPON said resolution was declared duly passed and adopted. <br />Page 2 of 3 Page 2 of 6 <br />
