4.0 BACKGROUND <br />4.1 The Midland Hills Country Club owns the golf course property addressed as 2001 <br />Fulham Street, which has a Comprehensive Plan designation of Golf Course (GC) and a <br />zoning classification of Single - Family Residence District (R -1). <br />4.2 A roadway had long existed in the location of the current VACATION request prior to the <br />construction of State Highway 280, at which time the longer roadway was removed and <br />replaced with a connection between Walnut Street in Lauderdale and the highway within <br />the highway's right -of -way (ROW). The Walnut Street ROW has therefore been <br />undeveloped at least since 1974. <br />4.3 Upon the collapse of the I -35w bridge on August 1, 2007 State Highway 280 was <br />designated as the primary detour route for the interstate, prompting the closure of <br />highway accesses from walnut Street, County Road B and other local streets. <br />4.4 Since the Planning Commission recommendation on March 5, 2008 the applicant has <br />been working with the City Engineer in the preparation of a legal description and survey <br />that meets the needs of the applicant and the City. The final survey and legal description <br />were received on May 9, 2008. <br />5.0 STAFF COMMENTS <br />5.1 when reviewing requests for vacating a public ROW, the Public works /Engineering <br />Department determines whether the request will, immediately or in the future, have an <br />adverse impact the general health, welfare or safety of the citizens of the City of <br />Roseville. Further, there needs to be a j oint determination from the Public works <br />Department and the Minnesota Department of Transportation (Mn /DoT) of whether the <br />Walnut Street ROW is or will be necessary to facilitate the distribution of traffic between <br />the Lauderdale neighborhood to the south and State Highway 280 to the north, whether <br />public utilities lie underneath the right -of -way, and how best to protect the public <br />interest. <br />5.2 Mn /DoT has plans to permanently eliminate local - street access to State Highway 280 in <br />that location in 2009. The Public works /Engineering Department has determined that the <br />City has no plans to improve walnut Street in that location and that the interests of the <br />public will not be compromised by vacating the portion of the walnut Street ROW that <br />overlaps the Midland Hills property. The site plan included with this staff report <br />(Attachment C) illustrates the walnut Street ROW subject to the VACATION request. <br />5.3 Some members of the public had called City staff to ask questions about the request, but <br />nobody indicated opposition; only the applicant was present at the public hearing. <br />5.4 The original request was to vacate the entire walnut Street ROW overlapping the <br />applicant's property, and Public works Department staff was generally supportive of this, <br />pending a determination of exactly where the property lines were located. Because the <br />Public works Department recommends maintaining the walnut Street ROW that lies <br />between State Highway 280 and a chain -link fence on the Midland Hills property <br />(indicated on the survey included as Attachment C) , the Public works Director <br />recommends approving the vacation of the portion of the walnut Street ROW that <br />coincides with the Midland Hills property south of the existing fence line. <br />PF08- 009_RCA_051908 (3).doc <br />Page 2 of 3 <br />
