Attachment D <br />1 CITY of ROSEVILLE <br />2 PLANNED UNIT DEVELOPMENT AGREEMENT #1364 <br />3 <br />4 This PLANNED UNIT DEVELOPMENT AGREEMENT ( "AGREEMENT "), dated <br />5 May 19, 2008 is entered into between the City of Roseville, a Minnesota municipal <br />6 corporation, of 2660 Civic Center Drive, Roseville, Minnesota 55113 ( "CITY ") and Cent <br />7 Ventures LLC, 1660 South Highway 100, Suite 500, St. Louis Park, MN 55416 and AmWest <br />8 Development LLC, 1715 Yankee Doodle Road, Suite 200, Eagan MN 55121 <br />9 ( "DEVELOPER "). For reference the City of Roseville project file is PF07 -021. <br />10 <br />11 1.0 EFFECTIVE DATE of AGREEMENT: <br />12 This AGREEMENT shall be effective upon completion of all of the following: <br />13 <br />14 1.1 Passage and submission for recording (County receipt) of Twin Lakes Addition, <br />15 the required subdivision plat for the property with the Ramsey County Recorder. <br />16 <br />17 1.2 Passage and publication of Ordinance # rezoning the property from <br />18 General Industrial (I -2) to Planned Unit Development (PUD) with an underlying <br />19 zoning of Mixed Use Business District (B -6). <br />20 <br />21 1.3 Execution of this AGREEMENT by the CITY and the DEVELOPER. <br />22 <br />23 2.0 REQUEST for PUD APPROVAL: <br />24 The DEVELOPER has requested that the CITY approve an 8.59 acre redevelopment <br />25 consistent With the Roseville Comprehensive Land Use Plan, the Twin Lakes Master <br />26 Plan, and the Twin Lakes Urban Design Principles into a Planned Unit Development <br />27 (PUD) that includes a 4- story, 123 room hotel generally at the northeast intersection of <br />28 Cleveland Avenue and the future Twin Lakes Parkway. <br />M, <br />30 The property is legally described as: <br />31 <br />32 Lot 1, Block 1, Twin Lakes Addition <br />33 <br />34 3.0 PUD APPROVAL: <br />35 The CITY hereby grants approval of the amended Planned Unit Development (identified <br />36 as Exhibits A through I in Section 4.0 of this AGREEMENT), subject to the <br />37 DEVELOPER's compliance with the terms and conditions of this AGREEMENT and <br />38 any and all applicable requirements of Title 10 of the Roseville City Code, unless <br />39 otherwise identified herein. The City agrees to approve applications for building permits, <br />40 if said applications are consistent with the plans identified in Section 4.0 below. <br />41 <br />1 <br />
