42 For any improvements not contemplated in this AGREEMENT, the CITY may require
<br />43 compliance With any amendments to the Comprehensive Guide Plan, official controls,
<br />44 platting or dedication requirements enacted after the date of this AGREEMENT.

<br />46 4.0 APPROVAL by the CITY:
<br />47 The CITY hereby approves the following plans and agreements (as Exhibits to the PUD
<br />48 AGREEMENT) on file with the City. The DEVELOPER shall develop the subject
<br />49 property in accordance with these plans and agreements. If, however, the plans or
<br />50 agreements are inconsistent with the written terms of this AGREEMENT, the written
<br />51 terms of this AGREEMENT shall control. If the plans address items not specifically
<br />52 addressed in this AGREEMENT, the plans shall govern with respect to those items. The
