305 9.14 Development Fees. Prior to the issuance of the building permit, the DEVELOPER shall <br />306 provide the CITY a cash payment covering the DEVELOPER'S proportionate share of <br />307 the cost for preparing the Alternative Urban Area Review (AUAR) (estimated at <br />308 $3,884.14); the proportionate share for the cost of preparing the Twin Lakes Allocation <br />309 Study (covered in infrastructure cost); and the proportionate share of the infrastructure <br />310 costs as identified in the Infrastructure Improvements for the Twin Lakes AUAR Area <br />311 dated February 2008 (estimated at $383,888.88). Specifically for this development, the <br />312 DEVELOPER shall provide the CITY $387,773.02. Should the DEVELOPER'S cost <br />313 share change due to a change in the development plan, the DEVELOPER shall submit the <br />314 recalculated cost share to the CITY within 30 days. <br />315 <br />316 9.15 Temporary Access. A temporary emergency vehicle access road shall be constructed <br />317 from County Road C within the Mount Ridge Road right -of -way to the subject property, <br />318 then west to the parking lot. This roadway shall be constructed at a minimum 20 foot <br />319 width and of an all weather design approved by the Fire Marshall. <br />320 <br />321 9.16 Pedestrian Connections. Pedestrian connections from the hotel to the future public <br />322 sidewalks shall be installed within 6 months of public sidewalk construction. The sidewalk <br />323 connection plan shall be reviewed and approved by the Development Review Committee <br />324 <br />325 9.17 Future Vehicle Access. An additional public street access to the north/south public street <br />326 located to the east of this site shall be constructed within 6 months of the public street <br />327 construction. This access shall be reviewed and approved by the City Engineer prior to <br />328 construction. <br />329 <br />330 9.18 Cleveland Avenue Access/Improvements. The proposed driveway onto Cleveland <br />331 Avenue shall be aright in/ fight out. This will be accomplished by extending the median 100 <br />332 feet to the north. Modifications to Cleveland Avenue shall be reviewed and approved by the <br />333 City Engineer and County Engineer prior to construction. <br />334 <br />335 9.19 Final Right- of- Way/Public Easements. Upon completion of the roadway design for Twin <br />336 Lakes Parkway and Mount Ridge Road, the City Engineer shall provide the DEVELOPER <br />337 with the necessary right -of -way location and width and the necessary public easement <br />338 location and width for that portion of Twin Lakes Parkway and /or Mount Ridge Road <br />339 affecting the site. The DEVELOPER shall be responsible for providing the information to the <br />340 surveyor for inclusion on the Final Plat. The Final Plat documents shall be revised and <br />341 submitted to the CITY for signatures within 30 days of the provision of information by the <br />342 City Engineer. <br />343 <br />344 10.0 DEVELOPER DEFAULT: <br />345 10.1 For purposes of this AGREEMENT, the failure of the DEVELOPER to perform any <br />346 covenant, obligation or agreement of the DEVELOPER hereunder, and the continuance <br />347 of such failure for a period of thirty (30) days after written notice thereof from the City <br />348 shall constitute a DEVELOPER default hereunder. Within the sixty (60) day period after <br />349 notice is given, a request maybe made for a hearing (by either party) to be held before <br />9 <br />
