City of Roseville <br />PROJECT: "ar Mar Apartments <br />RANT AMOUNT: <br />oU C I E ACTION. <br />$1217500.00 <br />Jan uary 9, 2008 <br />RANT No. O07 -I4 <br />FUNDING CYCLE: Fall 2007 <br />EXPIRATION DATE: December 31, 2009 <br />METROPOLITAN LIVABLE COMMUNITIES ACT <br />GIANT AGREE MENT <br />THIS I�A1 T AGREEMENT ENT ( "Agreement ") is made and entered into by the Metropolitan <br />Council (""Council") and the Municipality or Development. Authority i- dentified above as "Grantee," <br />WHEREAS, Minnesota Statutes section 473.251 creates the Metropolitan Livable Communities <br />Fund, the uses of which fund i -mist be consistent with and promote the purposes of the Metropolitan <br />Livable COMMUllities Act ( and the policies of the ouncil.�s 1 etropoli.tan Development <br />Guide; and <br />WHEREAS, Minnesota Statutes sections 47-3,251 and 473.252 establish within the Metropolitan <br />Livable omn -nun ities Fund a Tax Base 'devitalization Account and require the Council to use the <br />finds in the account to make grants to Municipalities or Development Authorities for the cleanup of <br />polluted lard in the seven - county metropolitan area; and <br />WHEREAS, the Grantee is a Municipality or a Development Authority as defined in Minnesota <br />Statutes section 473.252, subdivisions 1 and 1 a; and <br />WHEREAS, the Grantee seeps funding in connection with an application. for Tax Base <br />Devitalization Account funds submitted in response to the Council's notice of availability of grant <br />funds for the "Funding Cycle" identified above and will use the grant funds made available under <br />this Agreement to help fund the "'Protect" identified in the application; and <br />WHEREAS, the Council awarded Tax Base Revitalization Account grant funds to the Grantee <br />sub* to the council's ern.irrent domain policy and any terms, conditions or c�lari f�.c:atioris stated in <br />its Council Action, and with the understanding that the Project identified in the application will <br />proceed to completion its a timely manner and all grant funds will be expended prior to the "Expiration <br />Date" identified above. <br />NOW THEREFORE E, in reliance on the above statements and in consideration of the mutual <br />pror rises and covenants- contained in this Agreement, the Grantee and the Council agree as follows: <br />1.
