neighborhood, Planning Commission or City Council any Voice, since it would be a permitted use, with <br />approval based on the same code and design requirements. <br />Commissioner Best opined that he liked this use; that it represented a much improved use of the site; and <br />concurred with observations of Commissioner Boerigter regarding traffic issues pre - existing this proposed <br />use; and that it would have a lower impact than some other potential but permitted uses. Commissioner <br />Best further noted that, while the property owner was not compelled to provide a sidewalk and other <br />amenities, he appeared more than willing to work with the neighborhood and staff; and that this appeared <br />to be a good use of the site and good for the community overall. <br />Commissioner Martinson opined that this was a good addition for the neighborhood and that this <br />represented a type of neighborhood business as previously discussed by the Commission, with this type <br />of facility fitting in. Commissioner Martinson suggested that adjustments could be made in median design <br />that could alleviate some of the issues to split traffic to require a right turn, with no option for a left turn. <br />Commissioner Wozniak recognized Commissioner Martinson's suggestion; and offered his acceptance of <br />some type of limit for traffic; however, noted that while those concerns could be expressed, they couldn't <br />be made a condition of rezoning approval. <br />Additional discussion included addressing or remedying traffic issues within the land use approval <br />timeframe and limitations of that approval timeframe. <br />Commissioner Doherty noted that he would support a continuation; could not support approval; but <br />questioned if concerns expressed were sufficient enough to constitute findings of fact for denial <br />MOTION <br />Member Boerigter moved, seconded by Member Best to RECOMMEND APPROVAL of a <br />REZONING of the property at 621 Larpenteur Avenue from the existing B -2 (Retail Business) <br />Zoning District to the proposed B -3 (General Business) Zoning District; based on the comments <br />and findings outlined in Sections 5 and 6 of the project report dated June 4, 2008. <br />Roll Call Vote: <br />Ayes: Martinson; Best; Boerigter (3). <br />Nays: Wozniak; Doherty; Bakeman (3). <br />Chair Bakeman requested that the record clearly reflect the significant issues and concerns addressed by <br />the public and Commissioners: traffic concerns; residential neighborhood impacts; preferred access on <br />Larpenteur; pedestrian way to the bus stop; and other discussion items as referenced above. <br />Commissioner Doherty spoke in support of the project itself; provided those concerns as discussed could <br />be resolved. <br />Chair Bakeman concurred; speaking in support of the concept itself; opining her desire for site plan <br />modifications. <br />Commissioner Wozniak encouraged the applicant to continue working with staff prior to the upcoming <br />City Council meeting. <br />MOTION <br />Member Doherty moved, seconded by Member Wozniak to RECOMMEND APPROVAL of a <br />VARIANCE to Section 1005 of Roseville City Code, that would allow the parking area to encroach <br />into the required setback from the eastern property line; based on the comments and findings <br />outlined in Sections 7 and 8, and subject to the conditions detailed in Section 9 of the project <br />report dated June 4, 2008. <br />Roll Call Vote: <br />Ayes: Wozniak; Martinson; Best; Boerigter; Doherty; and Bakeman (6). <br />Nays: None. <br />Motion carried. <br />Page 5 of 5 <br />
