Draft Resolution Attachment H <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, Was held on the 16th day of June, 2008, at 6:00 p.m. <br />The following members Were present: ; <br />and was absent. <br />Council Member introduced the following resolution and moved its adoption: <br />RESOLUTION No. <br />A RESOLUTION APPROVING A VARIANCE TO §1005 (BUSINESS DISTRICTS) OF <br />THE ROSEVILLE CITY CODE FOR FICEK INVESTMENT COMPANY, LLC AT 619- <br />637 LARPENTEUR AVENUE (PF08 -017) <br />WHEREAS, Ficek Investment Company, LLC is the owner of property at 619 -637 <br />Larpenteur Avenue; and <br />WHEREAS, the subject property is legally described as: <br />ASYLUM OUT LOTS SUBJ To ESMTS & RDS; <br />S 185 FT of PART W of WW RIW of BLK 1 <br />PIN: 14- 29 -23 -44 -0045 <br />WHEREAS, Section 1005.01 (Minimum Dimensional Requirements) requires a 15 -foot <br />setback from the right -of -way for a parking area in a B -3 Districts; and <br />WHEREAS, the property owner seeks to create a parking area that is 5 feet from the Dale <br />Street right -of -way, requiring a 1 0-foot variance; and <br />WHEREAS, The Roseville Planning Commission held a public hearing regarding the <br />requested VARIANCE, concluded that "hardships" are present, and voted 6 -0 to recommend <br />approval of the request based on the comments, findings, and conditions of the staff report dated <br />June 4, 2008; and <br />WHEREAS, the Roseville City Council concurs with the Planning Commission <br />conclusion pertaining to "hardships" and has determined that approval of the requested <br />VARIANCE will not compromise the public health, safety, and general welfare of the citizens of <br />Roseville; <br />Page 1 of 3 <br />
