Attachment A <br />10. Department Access. The Department Police Chief, or the Chief's designee, will <br />have access to the storage facility at any time, and without notice, during Mid America's <br />regular business hours. Mid America will cooperate with Department requests for access <br />to the storage facility that occur outside Mid America's regular business hours. <br />11. No Access by Owner. Mid America will not allow anyone, other than the <br />Department Police Chief or the Chief's designee, to have access to the storage facility for <br />the purpose of inspecting or retrieving a seized vehicle or retrieving the contents of the <br />vehicle. The Department will be responsible for all communications with the owner or <br />entity authorized to possess the vehicle, and the Department Police Chief or Chief's <br />designee will be responsible for the removal of the contents of the vehicle, if necessary. <br />12. No Authority to Release. Mid America will have no authority to release a seized <br />vehicle to an owner or entity authorized to possess the vehicle, or anyone else other than <br />to the Department Police Chief or the Chief's designee. <br />13. Maintenance of Properly. Mid America will, at its own expense, maintain the <br />storage facility and parking and loading areas in a safe and suitable condition. Mid <br />America will be responsible for detecting, storing and disposing of any hazardous or <br />polluting substances, including but not limited to oil, gas, anti - freeze, and coolant, from <br />the stored vehicles. <br />14. Term /Renewals. <br />a) The initial term of this lease will be one year, commencing on April <br />2008 and ending on April __, 2009; <br />b) The Department will have the right to extend this Agreement for additional <br />and successive terms subject to (c) below; <br />c) This Agreement will automatically be renewed for each successive renewal <br />term unless (1) either party notifies the other, in writing, of its intention not <br />to renew the Agreement at least sixty (60) days prior to the end of any <br />initial or renewal term; or (2) either party is in default of any of the material <br />terms of the Agreement. <br />15. Insurance. <br />a) The obligation to provide automobile insurance will be, at all times, the <br />responsibility of the vehicle's owner. <br />II <br />
