Attachment A <br />c) Mid America may withhold repair fees from the auction sale price, as <br />authorized in writing by the Department. <br />d) Mid America will pay to the Department an amount equivalent to the <br />auction sale price, less the sell fee, cleaning and detail service fee, and any <br />authorized repair fees ( "auction proceeds. ") <br />e) The payment for the auction proceeds, and a Consignment <br />Agreement/Public Auction document will be available to be picked up by <br />the Department at Mid America's office within five business days of the <br />auction. <br />6. Vehicles Not Sold at Auction. In the event that a vehicle, eligible for auction, is <br />not or cannot be sold at public auction, Mid America may sell the vehicle for scrap or <br />otherwise offer the vehicle for sale, provided that the Department gives prior approval for <br />such a disposition. A vehicle sold for scrap or for sale will not be subject to the sell fee. <br />Mid America will be entitled to retain the sales price, up to $500.00. Any amount over <br />$500.00 will be paid to the Department. The payment, and /or the sales record will be <br />available to be picked up by the Department at Mid America's office within five business <br />days of the sale. <br />7. Storage Premises. Mid America agrees to store vehicles seized and transported to <br />Mid America in a secure indoor facility owned or leased by Mid America. The facility <br />will be suitable for the storage of motor vehicles, and will comply with all city, county, <br />state, and federal regulations regarding motor vehicle storage, including but not limited to <br />regulations regarding zoning, fire, pollution, and hazardous materials. <br />8. No Tampering. Mid America Auctions agrees not to remove, relocate, or <br />otherwise tamper with the stored vehicles without the Department's prior written <br />authorization or consent. <br />9. Kevs. <br />a) The keys and electronic access devices for the stored vehicles maybe either <br />retained by the Department or provided to Mid America. Mid America <br />agrees not to make copies of the key or device, and to take reasonable steps <br />to secure the key or device in a lock box while in its possession and control. <br />b) Within five days prior to auction, the Department will provide Mid <br />America with all keys and /or electronic access devices for the vehicle. <br />3 <br />
