Attachment E <br />DRAFT <br />1 CITY of ROSEVILLE <br />2 PLANNED UNIT DEVELOPMENT AGREEMENT #1379 <br />3 <br />4 This PLANNED UNIT DEVELOPMENT AGREEMENT ( "AGREEMENT "), dated <br />5 December 15, 2008 is entered into between the City of Roseville, a Minnesota municipal <br />6 corporation, of 2660 Civic Center Drive, Roseville, Minnesota 55113 ( "CITY ") and Metro <br />7 Transit, a of 560 Sixth Avenue North, Minneapolis, Minnesota 55411 <br />8 ( "DEVELOPER "). For reference the City of Roseville project file is PF08 -023. <br />9 <br />10 1.0 EFFECTIVE DATE of AGREEMENT: <br />11 This AGREEMENT shall be effective upon completion of all of the following: <br />12 <br />13 1.1 Passage and submission for recording (County receipt) of Twin Lakes Addition, <br />14 the required subdivision plat for the property with the Ramsey County Recorder. <br />15 <br />16 1.2 Passage and publication of Ordinance #1379 rezoning the property from General <br />17 Industrial (I -2) to Planned Unit Development (PUD) with an underlying zoning of <br />18 Mixed Use Business District (B -6). <br />19 <br />20 1.3 Passage and execution of the INTERAGENCY AGREEMENT for the I -35W and <br />21 COUNTY ROAD C PARK and RIDE regarding roadway and other public <br />22 infrastructure improvements for Iona Lane and Mount Ridge Road. <br />23 <br />24 1.4 Passage, execution, and recording of this AGREEMENT by the CITY and the <br />25 DEVELOPER. <br />26 <br />27 2.0 REQUEST for PUD APPROVAL: <br />28 The DEVELOPER has requested that the CITY approve an 1.2 acre redevelopment <br />29 consistent With the Roseville Comprehensive Land Use Plan, the Twin Lakes Master <br />30 Plan, and the Twin Lakes Urban Design Principles into a Planned Unit Development <br />31 (PUD) consisting of a 4- story, 460 stall park and ride facility generally at the northeast <br />32 corner of the Old Dominion parcel. <br />33 <br />34 The property is legally described as: <br />35 <br />36 Lot 1, Block 1, Twin Lakes Addition <br />37 <br />38 3.0 PUD APPROVAL: <br />39 The CITY hereby grants approval of a Planned Unit Development (identified as Exhibits <br />40 A through I in Section 4.0 of this AGREEMENT), subject to the DEVELOPER's <br />41 compliance with the terms and conditions of this AGREEMENT and any and all <br />42 applicable requirements of Title 10 of the Roseville City Code, unless otherwise <br />43 identified herein. <br />44 <br />1 <br />
