45 The City agrees to approve applications for building permits, if said applications are
<br />46 consistent With the plans identified in Section 4.0 below. For any improvements not
<br />47 contemplated in this AGREEMENT, the CITY may require compliance with any
<br />48 amendments to the Comprehensive Guide Plan, official controls, platting or dedication
<br />49 requirements enacted after the date of this AGREEMENT.

<br />51 4.0 APPROVAL by the CITY:
<br />52 The CITY hereby approves the following plans and agreements (as Exhibits to the PUD
<br />53 AGREEMENT) on file with the City. The DEVELOPER shall develop the subject
<br />54 property in accordance with these plans and agreements. If, however, the plans or
<br />55 agreements are inconsistent with the written terms of this AGREEMENT, the written
<br />56 terms of this AGREEMENT shall control. If the plans address items not specifically
<br />57 addressed in this AGREEMENT, the plans shall govern with respect to those items. The
