45 The City agrees to approve applications for building permits, if said applications are <br />46 consistent With the plans identified in Section 4.0 below. For any improvements not <br />47 contemplated in this AGREEMENT, the CITY may require compliance with any <br />48 amendments to the Comprehensive Guide Plan, official controls, platting or dedication <br />49 requirements enacted after the date of this AGREEMENT. <br />50 <br />51 4.0 APPROVAL by the CITY: <br />52 The CITY hereby approves the following plans and agreements (as Exhibits to the PUD <br />53 AGREEMENT) on file with the City. The DEVELOPER shall develop the subject <br />54 property in accordance with these plans and agreements. If, however, the plans or <br />55 agreements are inconsistent with the written terms of this AGREEMENT, the written <br />56 terms of this AGREEMENT shall control. If the plans address items not specifically <br />57 addressed in this AGREEMENT, the plans shall govern with respect to those items. The <br />58 plans are: <br />59 <br />60 Exhibit A Existing Boundary, Location, Topographic, and Utility Survey, dated <br />51 November 3, 2008. <br />62 Exhibit B Twin Lakes Addition (subdivision plat of parcel), Final Plat (not <br />63 receorded version) dated November 3, 2008. <br />64 Exhibit C Site Development Plan, including property boundary, building setbacks, <br />65 structure location, curbing, islands, driveways, parking lot and setbacks, <br />66 dated November 3, 2008. <br />67 Exhibit D Grading and Drainage Plan illustrating existing grades and those proposed <br />68 after completion of the proposed construction, drainage directions, and <br />69 spot elevations, proposed structure footprints including finished floor <br />70 elevation, dated November 3, 2008. <br />71 Exhibit E Utility Plan indicating proposed sanitary sewer, watermain, manholes, <br />72 storm sewer lines, catch basins for surface water catchment, sub - surface <br />73 storage system, dated November 3, 2008. <br />74 Exhibit F Storm Water Treatment Plan, providing details on storm water <br />75 management for the site development project, dated November 3, 2008. <br />76 Exhibit G Landscape Plan including materials list, sizes, and locations of all plant <br />77 materials, concrete sidewalk, and decorative elements, dated November 3, <br />78 2008. <br />79 Exhibit H Floor Plan, dated November 3, 2008. <br />80 Exhibit I Building Elevation indicating linear dimensions, height, and materials, <br />81 dated November 3, 2008. <br />
