specifically involves hazardous waste, the types and quantities are of a household <br />nature and scale and the facility is built and operated to protect against spillage of <br />these materials. Although a public entity already owns the property, Planning <br />Division staff nonetheless believes that the operation of the HHW collection site <br />will adequately protect the site from contamination. <br />b. The proposed use will not create an excessive burden on parks, streets, and other <br />public facilities. With an average of 150 vehicles visiting the HHW collection site <br />on its operational days, the traffic generated by the facility is well within the <br />capacity of Larpenteur Avenue, and Planning Division staff believes that the <br />waste collection use itself is conducted and located in a way that has no effect of <br />other public facilities. <br />C. The proposed use will not be injurious to the surrounding neighborhood or <br />otherwise harm the public health, safety, and general welfare. The HHW <br />collection use has operated periodically for nearly 20 years and Community <br />Development staff is unaware of any complaints having been made about the use <br />during that time. Planning Division staff believes that the continuation of the use <br />in the same conscientious manner will ensure that it does not injure the public <br />health, safety, and general welfare. <br />6.0 PUBLIC COMMENT <br />The Planning Commission held the duly- noticed public hearing for this application on <br />April 6, 2011; draft minutes of the public hearing were not available at the time this <br />report was drafted. The bulk of the Planning Commission's discussion dealt with the <br />environmental performance of the HHW collection site, what sort of testing had been <br />done, and whether the operation continued to be monitored to ensure that that it was <br />being properly run. John Springman, representing Ramsey County, indicated that no <br />testing has occurred but that a Phase I assessment of the site was conducted prior to <br />initiating the INTERIM USE in 1992 and that the site operations are routinely inspected to <br />ensure that the HHW is being properly handled and is not creating contamination outside <br />of the specially constructed collection area. No one from the public commented on the <br />proposed INTERIM USE renewal.
