CASE NUMBER: 1350-81 <br />APPLICANT: 01' Mexico, Inc. <br />Page 2 <br />4, With respect to the rightrof -way of Lexington Avenue itself, it is <br />interesting to note that there has never been any additional dedication <br />beyond the normal 33 foot, two rod roadway on either the east side or <br />the west side. The east side, of course, was platted long before the <br />additional dedication of rights -of -way policy was established. The <br />parking lot on the east side also extends right up to the right-of-way <br />line without the normal 15 foot setback that would be required in a new <br />development. This parking is therefore, non - conforming but legal. When <br />Lexington Avenue was improved by the County recently, additional right- <br />of-way was not sought on the east side because of the impact it would <br />have had on the parking situation. No additional right -of -way was <br />required on the west side when the parking lot was approved and constructed, <br />It is the City's policy, however, to request right -of -way when Special <br />Use Permits are requested on contiguous property. In this case, we <br />suggest no right --of -way be considered on the east side because of the <br />severe implications on the parking capacity. Howevert an additional ten <br />feet of right -of -way on the west side should be considered. <br />5. The City of Roseville has applied for and has received a 75% grant for <br />construction costs of a bikeway to be constructed from a point just north <br />of Larpenteur on the west side of Lexington to County load D. For this <br />purpose, the dedication of ten feet of right -of -way on the west side <br />would be extremely helpful. The 75% gr ant does not apply to the acquisition <br />of right-of-way, but only for construction purposes. Thus, the cast of <br />acquisition of right -of -way will be borne entirely by the City, • This <br />construction will be accomplished in 1982+ <br />
