<br />Resolution No. 9386 <br /> <br />Page 2 <br /> <br />WHEREAS; it would be advantageous to the City, the defendant cities in the Action and <br />all other cities in Minnesota if the Action could be successfully challenged on appeal; <br /> <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Roseville that: <br /> <br />1. The City hereby requests the LMCIT to appeal the Action to the Minnesota Court <br />of Appeals on behalf of the City. <br /> <br />2. The City Manager is directed to transmit a copy of this resolution to the LMCIT as <br />soon as possible and to take such other actions as are necessary or expedient to <br />secure the assistance of the LMCIT and to prosecute the appeal in the event the <br />LMCIT agrees to represent the City. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Member <br />Mastel, and upon a vote being taken thereon, the following voted in favor thereof: Mastel, <br />Wiski, and Wall, and the following voted against the same: None. <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />STATE OF MINNESOTA) <br />) SS <br />COUNTY OF RAMSEY ) <br /> <br />I, the undersigned, being the duly qualified City Manager of the City of Roseville, County <br />of Ramsey, State of Minnesota, do hereby certify that I have carefully compared the <br />attached and foregoing extract of minutes of a regular meeting of said City Council held <br />on the 10th day of March, 1997, with the original thereof on file in my office. <br /> <br />WITNESS MY HAND officially as such Manager this 12th day of March, 1997. <br /> <br />~( <br />Steven R.
