Page 2. <br />property well, with minimal impact on their residential environment, <br />These neighbors have suggested the possibility of rezoning only that <br />portion of the site occupied by the existing structure, the parking, and <br />the access road (with reasonable contiguous land), and hold on the rezoning <br />of the remainder of the property until such time as the site may be <br />expanded with additional structures. The cornten people inform us that <br />they have no plans at the moment for such expansion. Discussions with the <br />Comten people Indicate their acceptance of this concept. Working with the <br />cten people, we will prepare, prior to the Planning Commission and council <br />meetings, a line which the Planning Commission and council may consider <br />as an interim zoning boundary, <br />5. A similar controllingf effect could be developed if the city were to <br />require a special Use Permit for site plan approvals for properties in the <br />$ -1 District similar to that Which has been done in the B -1B District* <br />Under these conditions, no expansion of the site for parking or building <br />could occur without public hearing, neighborhood involvement -, an issuance <br />of a special Use Permit for site plan approval, <br />if a portion of the site is zoned B -1 only, in our opinion, it predetermines <br />the ultimate rezoning of the remainder of the land. This is true because <br />there is no public street access to the remainder, and the development of <br />a single family area (with single family houses) in the remainder would be <br />impractical and unreasonable. Thus, the company would enjoy a certain <br />predetermination with respect to the zoning even though it might not be <br />granted until such time as a development proposal is presented, <br />6. With respect to the access road we have requested the Comten people to <br />prepare a more detailed plan of the roadway, its construction details, and <br />proposed landscaping to enhance the entrance from the existing Comten <br />property* The handling of the roadway and its ancillary landscaping would <br />be most important to the existing multi- family housing on the Canadian <br />Finance property immediately to the west of the proposed access drive. <br />
