Page 2 <br />right-of-way, In 1979, the city Council adopted a policy specifying under <br />what condition the additional right -of -gray will be requested on county Roads <br />and other streets where a right -of -way width has been designated to be <br />greater than that which exists. That policy specifies that right -of -way and/ <br />or easements will be required when the following actions are granted <br />a. A Plat <br />b. A 'Replat <br />c, A Registered band survey <br />d. Condominium filings <br />e, Lot widths <br />f. Administrative let splits <br />g. special Use Permits <br />h. Building Permits for vacant <br />parcels <br />i . Building Permits which result <br />in the replacement or enlarge- <br />ment of 50 or more of the <br />existing structure value <br />j. Building Perm -its and Variances <br />der certain specified <br />conditions <br />Thus, under this condition where an application for Special Use Permit is <br />requested, additional right -of -way would normally be rewired in accordance <br />with the policy. <br />7. The right --of -way of Lexington Avenue for this parcel, currently consists of <br />33 feet which is the normal two rod right-of-way to which the government <br />has rights on either side of a section line (Lexington Avenue is a section <br />line road) . The Ramsey county standard for Lexington Avenue calls for an <br />additional 16.5 feet of right -of -way on either side of the existing 66 foot <br />right -o.f -way. This right -of -way has been picked up along many areas of <br />Lexington Avenue in the past, <br />8, When aE Special Use Permit was recently granted to the Lexington Avenue <br />Plaza shopping Center people for live entertainment in the 011 Mexico <br />Restaurant, an additional 16.5 feet of right -of -way was obtained on the <br />west side of Lexington Avenue, contiguous to the of Mexico parking area, <br />You will also recall that when a special use Permit was issued for a new <br />gas station facility at the northwest corner of Lexington Avenue and <br />Larpenteur Avenue (Margolis Center), 16,5 feet of right -of -way was picked up <br />contiguous to Lexington Avenue as a result of that action. when a variance <br />was issued for the location of an automated banking facility just north <br />of the service station site, an additional six feet of right�of -way was <br />dedicated by Margolis with that action. Thus, in conformance with an <br />established policy, the question of additional right -of -way dedication with <br />respect to this application is appropriate. <br />9. The problem here is, of course, that an additional 16.5 feet of right-of-way <br />has considerable impact on the parking capacity of this part of the <br />Lexington Plaza Shopping Center property. Perhaps some reasonable adjust- <br />ment can be negotiated with the shopping center owners to fulfill the policy <br />requirement, yet minimizing the impact on the parking needs <br />
