CASE NUMBER: 1409-82
APPLI cAT : Patricia Lindahl
1 December 1982
Page 2
There -was also a petition signed by a considerable number of neighbors in
opposition to the proposal presented to the City Council for the hearing
on 15 October' 1979,
5+ The City has received no complaints from neighbors or others regarding
the operation, 6f the approved beauty shop during the three year period in
which it has been in operation. Mrs, Lindahl has indicated in conversations
with the staff regarding this application, that she has received no
complaints from neighbors, and that her operation has bean successful to
date. Because the Special Use Permit issued had a definite toination
date t at this point she is required to submit a new application for a
Special Use Permit to .continue the operation. Attached is a copy of a
statement dated 1 November 1982 from Mrs, Lindahl indicating her intent,
6. You will note, that at this point she desire s to be allowed to operate for
three days a week, and that the Special Use Permit be issued withou. t a
-..4 time restriction.
'Attached also is a copy of a survey of the property and a plan of the home
indicating the location of the beauty shop ' in the basement of the residence.
7. Notices of the hearing before the Planning Commission and Council have -
been - mailed to owners of property within 350 feet of the Lindahl
residence in accordance with the required procedures for a Special Use
Permit consideration, To dater the staff-has received no calls from
neighbors expressing questions or concerns. If there have been problems
with respect to this operation in the past three years, it is likely that
neighbors will express their concerns at the hearing, certainly in this
case, there has been a test of the impact for the neighbors to judge,
8. In most cases, Special Use Permits in the City are issued without time
limitations unless there is a definite indication of potential problems.
Lacking any expression of such concern, it would appear appropriate for
-the, Planning Commission and Council to consider the issuance of a Special
Use Permit as requested without a time limitation, Thus, the Planning
Commission and council may consider denial of the permit, or issuance of
the permit with conditions. If issuance is recommended, the conditions
might be as follows i •r
a, That the operation be confined to three days per week.
b. That no signs be allowed on the premises advertising the
beauty shop operation#
