Febnlary 2 2 , <br />TO: City Council <br />FROM: Tim Andre <br />SUBJECT: No Fat'ievance Process <br />Ding the past several months the Roseville Hunan Rights Commission <br />has reviewed the No Fault Grievance Process, This process alJ.cws for <br />early informal resolution of disputes stag fran actual or perceived <br />unfair dis cr ' .r nat . practices via a local Human Rights Commis s ion . For <br />those units interested in participating in this process, training will be <br />provided in March to representative rrerrbers of the con &scion in order to <br />provide information and guidance on the procedures to be adopted when pro! <br />cessinq a grievance. <br />The No Faint Grievance process is a means by which the State Department <br />of Hunan Rights is relieved of processing so= of the cases which <br />rewire only informal m Nation . 'Ihis provides the local Human Rights <br />Commission a. mans of becoming inforred of and involved in discriminatory <br />Practices in their cammnity. It also provides the grievant, if willing <br />to settle through this process, a speedier response through a Human Rights <br />Corrmi.ssion . <br />The representative of the local Human Rights C emission, when - processing <br />a discrinlimtion claim, does not act as a hearing officer, but as an <br />impartial individual assisting in a voluntary settlement. Once information <br />regarding the grievance is obtained, the representative informs the respond- <br />ent of the, grievance and the settlement desired by the grievant. If a <br />settl.errent is agreed to the claim is considered settled. If an agreement <br />is not reached, the grievant then has the option to either drop the claim <br />or forward the claim to the Mate Department of Hump. Rights <br />Because Minnesota Statute 363.06, Subd. 3 , sets forth that a charge of <br />discrimination east be filed within six (6) months of the discrimination <br />act, it is mandatory that local. Hunan Rights omissions receive a Taint <br />within four ( 4 ) months in order to allow time for local processing and for <br />the grievant, should a settleomt not be reached, to file with the State <br />Department within the six rnonth ti.m fra . Whenever a grievance is filed <br />with the state Department, the local Hunan Rights Cmmis s ion representative <br />who worked on the grievance would forward all information obtained during his <br />participation in the No Fault process to the State <br />The State has provided the City with a copy of the nanual which sets forth <br />the procedures to be follcwed by a local comet- ssion. This docent is <br />m=rently being revered by the City Attorney to detennine liability on the <br />part of the City, t will be forwarded to the Council as soon as <br />available, hopefully by the time of the Council 147ork Session. <br />
